UK Supreme Court Rules Proroguation of Parliament 'Unlawful'

Boris Johnson's decision to suspend Parliament was unlawful, the Supreme Court has ruled.

Mr Johnson suspended - or prorogued - Parliament for five weeks earlier this month, saying it was to allow a Queen's Speech to outline his new policies.

But the court said it was wrong to stop Parliament carrying out its duties in the run-up to the Brexit deadline on 31 October.

Downing Street said it was "currently processing the verdict".

Irrelevant. The EU has said no more delays. Parliment can pass whatever it wants, if the EU won’t budge, Parliment has to either accept May’s deal or BREXIT happens without one.

Even more importantly, Johnson has asked to call elections and has been rejected.

I’m not sure what the “screw the people” block hope to gain here.

I am utterly gobsmacked. I did not see this happening - to me this act of Boris seemed iffy but perfectly “legal” in line with an unwritten constitution.

The Supreme Court says no, it was illegal. Wow.

What could be the repercussions? Well it means parliament gets back of course, but what else?

Boris Johnson’s authority is destroyed. The implication is that he lied.

But Corbyn won’t call a vote of no confidence and even if Boris calls one on himself, Labour MPs won’t vote on it.

So parliament comes back and then what? At this stage I have no idea - I think no one does.

Can they call a vote on cancelling Brexit? I think they can call it, and there is a real danger that they will get 51% votes now. That would be horrible - I was betting currency-wise on a no-deal Brexit.

Perhaps they don’t get the votes? Then what? Boris can’t do anything, parliament can’t do anything.

This is a total mad-house.

Despite all that tuff talk about ‘throwing us out’ without a deal, they’ve realised that they don’t want to rid themselves of a cash cow so easily. They will grant as many extensions as they deem neccessary either to get us to cancel brexit or otherwise reduce us to a vassal state whose economic policy is prostituted to the interests of Brussels and Frankfurt whilst only theoretically being ‘independendent’.

This is judicial activism at its finest. The right to prorogue parliament is a Royal Prerogative, the Supreme court had no basis in statute law to justify interfering with a decision by the government like this.

Actually “the EU” hasn’t said anything of that sort.

Remember - it is a confederation that takes deliberation among members very seriously.

The Finnish PM who is the President this year has asked for a proposal by the end of this month.

France is threatening saying no to an extension.

But the EU has no ruling over the UK asking for a delay or cancelling Brexit - the UK holds the cards over those two.

The other countries can say no to an extension, but they need to do so unanimously.

Johnson CANNOT call for an election - read the “First Term parliament act” - he needs to get 2/3rds of the MPs voting for elections and he won’t get that.

You can’t call the ones who oppose Brexit as “screw the people” - remember that 48% voted remain, while 52% voted leave. That was close - no one will be happy with any option, because all of the options - leave, stay, half-in-half-out, all of them “screw a large % of the people”

Boris needs to do a floor speech much like William Wilberforce and question the British who they are. He needs to question whether they will remain a slave to the EU or if they will be a people and a country of their own. If they choose to be the EU then he should step down. But I do not think if he gives the right speech they will leave him on an island. If the speech is good enough with all the cameras rolling I believe he will get what he needs. I hope he is a praying man because he will need the strength and words that the good Lord will give him if he asks.

The British people need to rise up are they are going to be betrayed and subjugated. If they merely protest, they will be locked up and their new rulers will drink champagne over their huddled masses.

Sigh, it was an advisory, non-binding referendum - referenda don’t have a role in the British political life.

The referendum was close but the advice was “leave”

What mattered is that parliament voted in November 2016 to listen to that advice and voted to call for article 50 in March 2017 (to leave on March 2019).

The UK is a representative democracy - parliament is sovereign, not the people. So if the UK parliament tomorrow decides to cancel Brexit or anything, they can. But hopefully they won’t.

The final thing is - the referendum asked “Leave or remain” - nothing more specific.

If the UK goes for a Norway-type deal (as Farage promised during the referendum campaign) then they get EU migrants, pay into the EU budget, and follow EU regulations and the ECJ and THEY Still “leave” so “listen to the referendum”

My hope is that they keep fighting among themselves and leave on October 31 with no deal

I’m not so sure about that - the rights and privileges and limitations are vague. This is a failure in setting the rules and limitations between parts of government. The UK has muddled along with no rules for centuries, but now looks like the end of that and the UK

My understanding is that the queen prorogued parliament, not Boris Johnson, and that she absolutely has the ability to do that.

I didn’t even know the UK had a supreme court....I thought it was just the Lords, but didn’t have any real supremeness about it....just sort of an advisory opinion.

is this the UK’s Marbury v Madison?

The Queen is basically a figure head. The prime minister’s office usually had all the power unless there is a minority government.
