The brother of one of the victims killed in a collision with Kevin OLearys boat says if the Shark Tank star or his wife are found guilty of wrongdoing, theyve got to do the time.
Larry Poltash said hes searching for answers in the death of his younger brother, Gary Poltash, who was killed instantly in the crash Saturday night on Lake Joseph in Ontario.
He told the Toronto Sun that while he hopes it was all an accident, OLeary and his wife, who was driving the boat at the time, should be held accountable if it wasnt.

I find this inarguable. If Mr. or Mrs. O’Leary is guilty of a crime, he or she should pay whatever penalty the law designates.
It’s so boring that statements of tautologies are “news.”
Pretty straightforward who was at fault. If Olearys Boat struck the other boat on the port side and the other boat DID have running lights on its a slam dunk.
His brother’s boat did not have lights on and fled the scene.
Good luck with that.
However, if the wife was in the least bit intoxicated ...manslaughter.
She passed the intox test police said.
O’Leary’s wife passed a DUI test. O’Leary’s state that the 13 passenger boat did not have running lights on and then fled the scene.
The initial report was the running lights were not on. People in the other boat say theirs WERE on and OLearys boat had none.

You don’t know that as fact.
The running lights are what is in question.
I guess it’s just 2 group’s words against each other then, right?
When I drove a cab i saw a few cars on the road with NO front headlights on.
Either burned out or they were burned out lol
There’s a lot more people around during a car accident (usually) to testify as to the truth.
I guess not with boat accidents.

Chances are... They were all drinking. The attorneys will keep any of them from spending any time behind bars. They will probably assign a percentage of blame to each pilot, and the attorneys will divvy up the money from the insurance companies.
There was a similar accident here years ago. Apparently, the investigators looking at the wreck could determine whether the lights were on at the time of the crash by examining the wrecked bulbs.

I was wondering if there was any forensics work that could be done. I never thought of that.
I clearly remember reading that in the first media report I read.
Probably true with incadescents (they get hot and the bulb shatters when exposed to the cold water), but not so much with LEDs.
Except the boat they struck apparently had no running lights, and no lights on at all in the dead of night.
