Some years ago, Dr. Tim Ball wrote that climate scientist Michael Mann “belongs in the state pen, not Penn State.” At issue was Mann’s famous “hockey stick” graph that purported to show a sudden and unprecedented 20th century warming trend. The hockey stick featured prominently in the IPCC’s Third Assessment Report (2001), but has since been shown to be wrong. The question, in my view, is whether it was an innocent mistake or deliberate fraud on Mann’s part. (Mann, I believe, continues to assert the accuracy of his debunked graph.) Mann sued Ball for libel in 2011. Principia Scientific now reports that the court in British Columbia has dismissed Mann’s lawsuit with prejudice, and assessed costs against him.
What happened was that Dr. Ball asserted a truth defense. He argued that the hockey stick was a deliberate fraud, something that could be proved if one had access to the data and calculations, in particular the R2 regression analysis, underlying it. Mann refused to produce these documents. He was ordered to produce them by the court and given a deadline. He still refused to produce them, so the court dismissed his case.
The rules of discovery provide that a litigant must make available to opposing parties documents that reasonably bear on the issues in the case. Here, it is absurd for Mann to sue Ball for libel, and then refuse to produce the documents that would have helped to show whether Ball’s statement about him–he belongs in the state pen–was true or false. The logical inference is that the R2 regression analysis and other materials, if produced, would have supported Ball’s claim that the hockey stick was a deliberate fraud on Mann’s part.

Consequently, his chart of “modern times” starts at exactly the point where temperatures began to rise.
We have a similar flaw in our temperature satellite data.
From 1940-1980, we had below average cool weather.
The first weather satellites launched in 1979, exactly when temperatures began to rise.

Doesn’t give up the research data despite court orders. The antithesis of the scientific method and the desire for truth.

If you make up s#it and gain some benefit (like a grant, promotion, speaking fees, etc) you are legally a fraud and deserve whatever justice the Courts meet out.
If you are a scientist and do it you have also engaged in scientific fraud, for which you deserve the condemnation of all educated men everywhere. You name should go in the history books for perpetrating yet another hoax on humanity.
While I believe that human generated climate change is a hoax, the greenhouse gas theory is sound physics. The question is whether human production of greenhouse gases makes any difference to climate and that is the thing that has not been proven. The greenhouse gas theory is demonstrated all over the earth every day, any time you get heat trapped because of a layer of clouds, smog, etc.
Shut off the Sun and the earth is an ice ball.

Good point.
It’s important to note that during the Little Ice Age, sunspots hit a minimum (cooler sun) (~1650-1720, the Maunder Minimum) and those same sunspots began to increase about the same time as the industrial revolution and Current Warming Period.
So as you say, the climate kooks start their pretty little graphs right at the end of a natural cooling time period.
What prediction did I make that includes a “hockey stick”? That’s right; I didn’t.
