The Justice Department submitted a legal brief to the Supreme Court Monday that stated President Trump acted lawfully when he decided to end the Obama-era immigration program known as DACA in September of 2017, according to a new report.
The Department of Homeland Security, correctly, and at a minimum reasonably, concluded that DACA is unlawful, Justice Department lawyers wrote in a brief submitted to the Supreme Court late Monday.
The Supreme Court will begin to hear arguments in November. A ruling is expected in the presidential election year, putting the high court at the center of one of the most politically charged issues of debates. A decision in favor of Trump would allow for the president to deport more than one million young adults residing in the U.S. under DACA protection, the New York Times reported.

The Kenyan from Indonesia repeatedly said he couldn’t implement law on his own, then he just did it.

For extra credit, I want to hear the explanation for why Obama had that power, but Trump doesn’t.
That is loser talk. Congress several times rejected DACA, said No. Obama illegally give them temporary amnesty--free public benefits and job permits. The court should recognize the illegality of this, confirm Trump AND Congress's end to DACA and after that there is nothing left except to deport them as their permits expire. They should say a gracious thank you for the education, healthcare, and public benefits they got, go home with that to fix their home countries. One million American educated young adults will have bigger impact on the cesspool countries than any financial aid package. Big impact.
If the USSC upholds DACA, then any unilateral policy, implemented by any president - including Trump - will be held legal.

Every court that reviewed Trump's DACA case said exactly the same thing:
Trump has the authority to write a new DACA policy - but - Trump does not have the authority to declare Obama’s DACA policy unconstitutional.
On Trump's first day in office Trump could have written this two sentence Executive Order:
“According to the exact language in the Immigration and Nationality Act of 1952, the DACA kids are unlawfully present in the USA. Consequently, I order the Secretary of Homeland Security to remove them.”
An E.O. worded like that cannot even be reviewed by a federal court.
Unfortunately, time and again, Trump has made it crystal clear that he does not want to deport any illegal immigrants except dangerous criminals.
Trump does have the authority to declare O’Bummer’s policy unconstitutional and the order you described would have been blocked by leftist judges too just like everything else he does.

Judge Alsup from the 9th Circuit wrote the first decision, and he specifically states that Trump has the authority to write a new policy.
I also suggest you browse through the Administrative Procedure Act.
The APA gives specific rules for overturning prior E.Os., and for writing new E.Os.
The APA also forbids federal judges from reviewing E.Os. that enforce the exact language of a statute.
Congress or some other plaintiff could go to court and claim that the statute - the Immigration and Nationality Act - is unconstitutional, but they cannot touch an E.O. written by Trump that seeks to enforce the exact language in the INA.
I repeat my original statement - Trump's E.O. was a political scam to extend DACA until the 2020 election.
If Trump is reelected in 2020, he will copy George W. Bush and offer Amnesty to non-criminal DACAs in exchange for bogus promises to build The Wall.
