A Sacramento-based Third District Court of Appeals has overturned the 2017 conviction of five men who were caught with marijuana in their prison cells, after California passed Proposition 64 legalizing recreational use of the drug.
But that doesnt mean inmates can light up joints while behind bars.

This makes absolutely no sense. They can’t possess tobacco (which also is not to be consumed in prison), as doing so warrants punishment, but they can possess cannabis?
I wonder when the majority of California will realize how backwards things are there as a result of their political choices?

In most states, the departments of corrections and/or with the state legislature, determine what is allowed and what is “contraband” for possession by inmates in the prisons.
Generally, this would have NO relationship to what is “legal to possess” within the state.
It may be “legal” to possess many things in CA, but that shouldn’t mean you can avoid 60 days in solitary for doing so.

The fact that they can’t keep drugs out of prisons is all the proof you need that the war on drugs is lost and needs to be abandoned. In a prison, they have more control of the population than the most totalitarian police state’s wet dream, yet drugs still make it in.

Legislators no longer know how to write legislation.
In his opinion, Presiding Justice Vance W. Raye said while state penal code prohibits smoking or eating marijuana while incarcerated it does not address possession.
