An IT company based in Silicon Valley has filed a lawsuit against the United States government for denying an H-1B visa to an Indian techie.
[….] The company asserts USCIS acted capriciously when they denied Anisetty the visa stating his position did not meet the criterion that "a baccalaureate or higher degree or its equivalent is normally the minimum requirement for entry into the particular position."
According to Xterra, they had submitted all evidentiary documents as requested which proved that Anisetty's appointment as Business Systems Analyst qualified all four criteria for an H-1B specialty occupation, yet, the USCIS gave no explanation for denying the company's petition for granting a visa. I understand completely why US citizens do not like H1-B visa foreign workers. However the drumbeat is to single out Indian workers as the culprits.

Maybe I have seen more than some here who mean well, but engage in knee-jerk reaction, without really having a sufficient amount of information.
You are right...I came on a student visa in 1960, did not want to work here longer than 18 months after graduating which was the maximum length of time allowed in those days.
It was my employer, a large industrial outfit in Chicago who talked me into staying and sponsored me for green card which I received in 1965, and US citizenship in 1970.

I keep telling people its not just tech. The Banks are stuffed full of them and its definitely not just tech jobs.
H1b abuse is just as big of an issue for me as the border. Both are part of the cheap labor express used to undercut Americans in their own country.
We have far too many of these low quality frauds.

I have seen them copy job descriptions directly to their resumes.
I actually ran into this problem with my dentist’s new assistant. I suspected poor English skills, but with the accent, it was hard to tell if she really responded to my questions.
Then she screwed up with the liquid numbing agent, some of which I accidentally swallowed. I snore mildly at night, but essentially experienced apnea AWAKE.
I could breathe out but not in. I tried to say I was choking. Signaled it with hands on my throat. She asked questions I couldn’t understand. Had to force my way up and out of the chair, intentionally knocking things over to get the attention of others who might be able to help.
I almost passed out.
Sitting upright and forward, my airway cleared enough for me to breathe. Once I could speak, she asked what had happened. I explained. “You didn’t tell me what was wrong.” “I couldn’t breathe.”
I told the dentist that the language barrier made her a threat to my safety as demonstrated by this incident. That she could not understand patients well enough to do her job.
I was called racist by the *)#&*!@.
I reminded everyone present that I just choked and nearly passed out because of her mistake AND inability to understand a patient saying she’d messed up anesthesia. If I’d been semi-sedated, I’d probably be dead.
I do not use that woman anymore.
