Indian techie denied H-1B visa; Silicon Valley firm sues government

An IT company based in Silicon Valley has filed a lawsuit against the United States government for denying an H-1B visa to an Indian techie.

[….] The company asserts USCIS acted capriciously when they denied Anisetty the visa stating his position did not meet the criterion that "a baccalaureate or higher degree or its equivalent is normally the minimum requirement for entry into the particular position."

According to Xterra, they had submitted all evidentiary documents as requested which proved that Anisetty's appointment as Business Systems Analyst qualified all four criteria for an H-1B specialty occupation, yet, the USCIS gave no explanation for denying the company's petition for granting a visa. Currently, Anisetty holds valid H-4 dependent status through his wife, the principal beneficiary of an H-1B application. [...]

I think rallying the troops is in the long run more effective than calls to bought-and-paid-for whores of the corporate globalists.

So why the emphasis on the employees are from India? Those Indians did not pass the H1-B visa system laws. It sure sounds like you are prejudiced redneck against the Indians.

If that was true, H1-B laws would have been abolished decades ago. I have seen tons of posts disparaging the H1-B visa system over last 10 years here.

Spend you time instead calling the congress critters who pass these laws which reduce employment for American citizens and also reduce prevailing wages because those H1-B visa people are willing to work for lot less.

The Indians are not in the habit of playing the race card. How many Indians have you seen in protest parades? Indians are too busy working hard and are now have larger net worths as a group than any other nationality, any other race including US born white Americans.

Unfortunately they also have the not-so-trivial 8140/8570 requirements, even for entry-level.

Now if there was a 8140-free part of IT that still required citizenship, I’d be interested.

Exactly the experiences I encountered. Indians are arrogant and patronizing, especially to women. They don’t seem to know very much and they don’t seem to take direction very well. I found it very frustrating to work with them and nearly impossible to correct them.

The design and validation quality at Intel was some of the best in the world until around 2005.
All the heavy lifters have now gone elsewhere or retired and the only people left are previous H1b who are now upper management.

I left in 2013 and will never go back.
Oh and BTW, the famous Pentium Flaw was covered up by the project head...from India.

Good input Laz.
I work for a Silicon Valley Company and when they had 15% layoffs last summer, only the Americans got the ax, including me.
Did you know that if they ax an H1B, they give him the regular severance package, but then they have to give him repatriation expenses, i.e., ticket back plus moving all their crap back, and if they own a house and can’t sell it in a timely manner, the company buys if from them.
So, it’s just cheaper to ax Americans than H1Bs.
