RW Arms Sues Federal Government for Losses from Bump Stock Ban

The repercussions of the BATFE rule change classifying bump stocks as fully automatic firearms continues.  RW Arms is a company located in Ft. Worth Texas.  The company distributes firearms parts and accessories in the United States. RW Arms had a large inventory of over 73,000 “bump stocks”, when the BATFE changed the regulations and classified bump stocks as automatic firearms. RW Arms joined with retailer The Modern Sportsman to sue the federal government for an uncompensated taking of their formerly legal product under the Fifth Amendment of the the U.S. Constitution. Fort Worth, Texas (April 8, 2019)–Fort Worth based retailer RW Arms, Ltd has filed a federal lawsuit seeking monetary damages for the fair market value of the 73,436 bump stocks it destroyed in compliance with the Bump Stock Ban that went into effect on Tuesday, March 26th. The ban, which was enacted by the Trump administration, reclassifies bump stock devices as machine guns, and therefore subject to regulation as part of the Gun Control Act of 1968. The rule requires that previously lawful owners destroy or surrender the device without compensation or be subject to a penalty of up to 10 years in federal prison and $250,000 in fines for each violation.

RW Arms joins retailer The Modern Sportsman in suing the federal government for this taking without just compensation. The lawsuit alleges that the regulation, which forces lawful owners to destroy or surrender the device, is a physical taking of their property without just compensation in violation of the 5th Amendment of the United States Constitution.

we definitely need to close down the ATF (and invite their employees to transfer into good jobs defending our borders against Moslem terrorists and saboteurs .. and Mexican drug gangs, etc.)

The Supreme Court has not conclusively defined what is a "taking" under the Constitution.

It's been a few years since I read through some of the relevant opinions, but IIRC, the deprivation of property rights has to be complete and also permanent before it qualifies. Since the value of the plastic butt stocks in question has become zero, the company may have a case...

I think bump stocks are stupid, but I don’t think they should be illegal any more than full auto. I wish full auto were like semiautomatic for purchase, but that’s another battle. At least you can get a full auto if you want to pay the tax.

Given the sequence of events, I think the bump stock company should be compensated for govt taking. It should come from ATF budget.

The idiots in DC don’t know what anything is about. Binary triggers are still allowed. If rapid fire is the desire you can go to that. I would lose my bump stock in a boating accident until the matter winds through the courts, if I owned one. The whole thing is because of the Vegas shooting, which hasn’t been sufficiently explained. This whole issue is BS.

SCOTUS isn’t legislative branch. Depriving them of something of material value violates Due Process under the 4th & 14th Amendments.
