Rand Paul to oppose Trump's emergency declaration, giving resolution votes needed to pass

Sen. Rand Paul of Kentucky says he will back a resolution that blocks President Trump’s declaration of an emergency at the southern U.S. border, giving it the votes needed to pass but not enough to turn back a presidential veto.

Mr. Paul, a Republican, announced his decision during a Saturday speech at Western Kentucky University, according to the Bowling Green Daily News.

“I can’t vote to give the president the power to spend money that hasn’t been appropriated by Congress,” Mr. Paul said. “We may want more money for border security, but Congress didn’t authorize it. If we take away those checks and balances, it’s a dangerous thing.”

The broken border is a national security emergency. Don’t vote for the Pelosi resolution. Don’t vote against the President fixing the broken border.

Where was Rand Paul’s resolution against Obama’s “national security emergency” declarations? It didn’t happen.

The emergency Powers Act would have never been chosen if Congress could actually pass something aligned with what the public thanks is a prudent course of action on the border. But Congress is not listening to the people that elected them.

bring on the veto

Trump's emergency declaration has the votes to withstand a veto override. The problem is the signal that "both houses of Congress opposed" will send to the Supreme Court when they get this "separation of powers" case.

Yes, in an ideal world congress should or would appropriate funds.

However, we are no longer in an ideal world and this attitude was nowhere to be found under the last President so this is one of those “hold your nose votes” the left makes with no problem or qualms.

They fight with everything they have and we don’t. It seems inevitable that the republicrats will one day sit in the losers bracket patting themselves on the back that “at least we did it right.” Sigh.

While he has a point in principle the constitution is very clear to me that border control is a matter of national defense so there have been many other “emergency declarations” on far shakier ground than this one.

I cant agree with your point on the constitution. I doubt he knows that much about what the founders meant when they wrote it.

The funny part is, that he is against any foreign military interventions, which I might agree with on some points, but he is against any defense/security against foreign invasions.

How the hell does that make any sense?

While there is certainly a large number of Federal judges out there who believe they have power and authority to stop actions of the Executive in an “emergency”, it’s not likely the USSC would eventually agree with them.

It really boils down to whether the Executive is willing to ceded that power to the Courts, when it’s apparent he is not willing to cede it to the Congress.

Especially after the Congress has formally ceded the power to the Executive via statute.

The singular and exclusive remedy for an Executive acting under Emergency is Impeachment and Removal.

Rand Paul is putting on the Ritz for his libertarian donors and supporters. Can someone tell Rand Paul that you can’t have libertarianism in an open borders country. The Central Americans and other illegals who are streaming in here are natural born socialists.
