The Supreme Court sent a case concerning a death row inmate, who claims he can no longer remember his crimes because of several strokes he had while in prison, back down to the lower courts to take a second look.
The court had already stayed the inmate Vernon Madison's execution last January. In a 5-3 vote, Chief Justice John Roberts sided Wednesday with the liberals on the court in favor of Madison.
Only eight justices had heard the case because Justice Brett Kavanaugh had not been confirmed by the time the case was argued.

John, pull yourself.....together.
Constitutional jurisprudence is not about the conclusion reached, be it “liberal” or “conservative”, but about the reasoning applied. The majority reasonably found it unclear whether the state court had properly applied the relevant precedents, and so sent it back for review: https://www.supremecourt.gov/opinions/18pdf/17-7505_2d9g.pdf
Let’s not join the leftists in treating the courts as policy-making bodies.
Gee, another Bush judge discovers his inner leftist. What a shock.
There fixed it, but, it's not like that's breaking news.
I know I know, better Roberts than Ruth on the court. He's probably the least liberal of the liberals on the court, which doesn't necessarily translate into the least damaging.
Important for conservatives to keep in mind we have only kind-of-a-tiny-majority and often not on the things that matter most. We don't really have a majority until and unless Ruth gets replaced.
Even USSC justices have to go out to eat, go to cocktail parties, and generally socialize in a city which is overwhelmingly populated by creatures from the Dark Side.
Takes a rare degree of integrity to withstand the constant goading to join the Borg to which they must be subjected.
That we have one such in the Oval Office strikes me as more of 'miracle' every day.
Guess the next step will be to release him since he can’t remember the crime with the rationale that if he can’t remember his crime then he can’t remember why he is being punished. He should have been put to death years ago for a crime that occurred in 1985. Instead he is still alive after almost 19 years while his victim had no such reprieve. That is not justice. Also look for a lot of other inmates convicted of murder to start claiming they can’t remember their crime.
It’s a process issue regarding legal mental competency.
We have checks and balances for a reason, to avoid harming the innocent even if it means some of the guilty escape justice.
I don’t have a problem with that.
Everyday it gets harder to believe we can save our Constitutional Republic.
I’d like to think there’s a tipping point soon when CW2 goes from cold to hot.
Yes, so we keep our fingers crossed...
We’re right where we were three years ago.
Bush, the dividend that keeps on paying off.
Roberts has always leaned lib and is moving further that way.
Vernon Madison murdered a policeman in 1985. Why is a 34 year reprieve a reason to let him off now? Where does the Constitution say that duly convicted murderers have to rationally understand their crime and punishment? (That is the court’s excuse). The crime remains the same. The perpetrator remains the same. The punishment, though unjustly delayed, must remain the same. Is the guy now a productive, safe citizen ready to be released into society?
It’s the Chewbacca defense! Brilliant!
Roberts IS a liberal. Why wouldn’t he side with them?
Um, sorry Mrs subterfuge, I forgot I was adulterous so you have to forgive me.
Yeah, that’ll work.
Sides with FELLOW liberals .... face it folks, we were duped.
I’m done giving Roberts the benefit of the doubt.
Perhaps...
But where did he come down on the decision?
Allowing a review is not the same as coming to a final conclusion -- one where Roberts again decided to stand with the liberals.
He is a LIBERAL since he’s being BLACKMAILED most likely about his adopted kids!!
See my link to the ruling in post #42; the conservatives' dissent was on procedural grounds (that the petitioner changed their argument after certiorari review was granted).
a final conclusion -- one where Roberts again decided to stand with the liberals.
There was no "final conclusion", only a sending back down for review.
Yep.
