Report: New York prepared to prosecute Manafort in case of Trump pardon

New York County District Attorney Cyrus Vance Jr. is prepared to file tax charges against Paul Manafort in the event that he is pardoned by President Trump for his conviction in the Mueller investigation, Bloomberg reports, citing two sources familiar with the matter.

Why it matters: Trump has not ruled out a presidential pardon for his former campaign chairman, who is set to be sentenced — and could face at least 19 years in prison — in Virginia on March 8 and D.C. on March 13. Vance has reportedly been investigating Manafort since 2017, months after he was charged for tax and financial fraud by the special counsel. Bloomberg notes, however, that laws that prevent defendants from being charged twice for the same crime could make the case difficult to prosecute.

18 U.S. Code § 242 - Deprivation of rights under color of law

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

To prosecute Hillary, there must first be a criminal referral to the Southern District of New York. Since she owns the FBI/DOJ, there is no such referral...... yet

If Cyrus Vance Jr. is so inclined to favor the corrupt system and individuals involved, he must be either suffering from great ignorance or he’s involved with organized crime known as the deep state.

Any crimes committed by Cyrus Vance should be prosecuted.

BS. There is a statute of limitations on this. mueller had to get a judge to wave it for manaford in the federal case. If the state were to do that as well, along with not going after podesta at the same time, I think there is a case for malicious prosecution.

Why doesn't Vance file the charges NOW?

Because "the law" has become a political weapon.

When Clinton was elected, his first act was to fire and replace every federal prosecutor, because several of his friends were being investigated. Trump should have done this and replaced them with non-partisan prosecutors (if there are any). All of the investigations of his friends disappeared.
