Attorney Alan Dershowitz said in a new interview that President Trump's decision to declare a national emergency to build a wall along the southern border was a mistake.
My own view is that it was a mistake to do it. I think emergencies are things that happened suddenly. The problems with immigration are long term, he said in an interview that aired Sunday on John Catsimatidiss radio show in New York...
Dershowitz predicted the declaration would face a long court battle.
There will be a lawsuit. No doubt about it. It will be tied up in the courts for a long time, he said...

Trump now has 8 Billion to build the wall before it hits the court date.
Lately Dershowitz occasionally gets something right. This isn’t the case.
The left continues their revolutions disinformation campaign.
Congress gave him the power to declare an emergency though legislation signed by a president. The only reason to even consider this in a court of law to engage in partisan politics.
Dersh may be a good lawyer but he isn’t a strategic thinker.
Trump just defined the principal 2020 election issue. You are either for the wall (and for Trump) or you are against the wall and thus, against American national security. The Dems will try to make it all about nuance and crap but that’s what it really comes down to.
Why can’t we do it?
Because the American people have elected a Congress which is passionately opposed to it and which will do anything, including removing the President, to stop it.
Exactly right, and just how many deaths at the border and beyond does it take?
The deaths other crime and drugs, not to mention the people jumping on our government programs, it has to stop right now.
The short answer is we are poisoned by political correctness.
Trump should have declared an emergency declaration when the caravans were coming to the border instead of dragging it out for months. But that’s history. If the courts rule against him Trump should ignore the courts and proceed anyway. He will be impeached but he will get the wall built.
Suddenly, we have caravans. Suddenly, we have spreading diseases we thought conquered. Suddenly, we have multitudes of purchased or stolen children being used as tickets for entry. Suddenly, we have a party preventing spending on border defense that spent quite freely in the past. Seems sudden to me.
The nature of a Declared National Emergency by definition does not allow for its activity/action to be subject to prior injunction, debate, or litigation. Litigation must needs be sought after the emergency is over.
In each case, when I pointed out the obvious historical irony of that position, they acted like they never thought of that before.
Whenever I see or hear Dershowitz now, I think of how he was Jeffrey Epstein’s lawyer and attacked those young girls to discredit them. Sorry, Dersh. You’re dirt to me.
To Dershowitz, as to wimpy mayors and governors who block the wall from being built:
You will be pleased to know we have diverted 2,000 aliens to your home. You may avail yourself of discount prices on cots and day beds.
The first are arriving within the hour and you should welcome them with hot meals, baths, medical condition attention and fresh bottled water. Your front and back yards will soon have moving trucks arriving with more hundreds of foreign nationals. Find translators for their languages.
As we know you are sensitive to these people we have demolished the wall surrounding your mansion.
Funny, I don’t remember Alan getting all upset when Obama declared twelve of them.
I do not believe that any judge below the supreme courts level has any right to put a stop to an emergency declaration by the president. And then it would only be if heard and decided by the full court. And I even question the legality of that since the decision to over ride it, according to law, is in the hands of the legislature and not the courts. Only if there is a black and white violation of the constitution, should the courts have any say at all.
Oh really Alan? Ever read the 31 active emergencies we still have from other presidents? None too urgent.
More are coming
