George Washington University Law School professor Jonathan Turley, a noted constitutional expert, explained the difference on Friday between President Barack Obamas legal case involving lawsuits against Obamacare and President Donald Trumps national emergency declaration.
Theyre using the case where I represented the House of Representatives against Obamacare. And we won. But this is not the same case, Turley said on Fox & Friends.
What President Obama did was order the Treasury essentially to be opened up and to pay insurance companies. Thats a different type of funding.
What Trump is going to do is hes going to use money that was appropriated by Congress. It just doesnt have these tight conditions on them. Thats Congress decision to make. They can appropriate money and not put many conditions on.
So its going to be a different fight, Turley continued.

Legally, the dems can’t even bring the case until Trump starts spending the emergency money in the 9th Circuit states. And if Trump doesn’t spend any of the money in the 9th circuit states, they would be forced into the other border circuits. But when does legally ever stop the dems.
They will find several judges who will be more than willing to execute a corrupt bargain with the Democrats. But, the attempts will be quickly swept aside probably without any effect on the schedule. The Supreme Court will defer this question to the electorate in the 2020 Presidential Contest.

The Democrats own a lot of Judges at the district level. Common sense tells us that a district judge does not have the authority to bring injunctions & stop orders against the president. However everyone acts as if they do.
The Democrats have spent at least the last 50 years packing all levels of the federal court system with their toadies.
Every time during the Carter Administration, during the Clinton Administration, during the Obama Administration that an activist judge who rules from the bench was appointed the Republicans, in the interest of getting along, approved it.
Now we are paying the price for the Mitch McConnell’s of the world.
Unless Trump comes out and says it is “not really” a crisis or an emergency (which he is wont to do)
