Virginia delegate Patrick Hope has outlined his plans to offer up articles of impeachment against Lt. Gov. Justin Fairfax.
In an email to his House Democratic colleagues, Hope says he plans to file a resolution first thing Monday morning that lists the reasons he believes that Fairfax's conduct warrants removal from office.
The embattled lieutenant governor of Virginia was accused by two women of sexual assault, including rape by one of the women. Fairfax released a statement on Saturday acknowledging both interactions with the women, but said both instances were consensual.
The resolution introduced by Hope would be the first step in the removal process. The process begins in the House and if it passes with a majority vote, it moves to the Senate where they will hold a trial to determine if Fairfax will be removed.
The resolution must have the support of the Speaker of the House, Republican Kirkland Cox, in order to even be brought for a vote for the house floor. He has not indicated if he will allow that to happen.

Over the weekend, House Speaker M. Kirkland Cox, R-Colonial Heights, asked Fairfax to resign immediately, calling his ability to serve permanently impaired and saying it is in the best interests of the commonwealth for him to resign.

So... “I BELIEVE HER”, I seem to remember that as being the democrat phrase du jour..
My questions, perhaps stupid given the politics:
1. Can someone be impeached for something which happened long before he was in office, for something which has nothing to do with his official duties?
2. Even if someone could be impeached for something other than events in his time in office, can he be impeached when he has never been charged or convicted in a court of law for the offending actions??
Good questions.
I do believe in “Due Process”. The Constitution of Virginia has something to say about these Impeachment proceedings.

Good to see a Dem doing this. If I were a Rep. delegate, I’d stay away from it as far as I could, demand due process for the man, and a full investigation. If I decided to vote for the resolution, I’d lay out grounds fully based on the evidence and want it to meet the same standards as would be required for an indictment by a skeptical grand jury. Right now this looks like one of the few cases in situations like this where the charging parties are on the right track.
This development is just delicious.
Fairfax has been used to being in the protected class his entire life. He will not resign. I don’t know what the best way to play this would be. You certainly don’t want to see Fairfax canned before Northam allowing Northam to name his replacement. I wonder how long the impeachment process would take?
If Fairfax is not chargeable he could reject the call to step down and tell the dems to pound sand and I doubt they would do anything.
The Democrats don't believe in "Due Process".
Let them fall by the same rules they try to impose on their opponents.
Come to think of it - there are no rules anymore. The Democrats destroyed them for short-term advantages. They are going to hate the new order of things just as much as we do.
