A former Green Beret who told Fox News in 2016 that he killed a suspected Taliban bomb maker nearly a decade ago during combat operations in Afghanistan is now being charged in the man’s death -- a move his lawyer says is an act of betrayal by the Army.
The murder charge facing Maj. Matthew Golsteyn comes after years of on-and-off investigations by the Army following an incident said to have taken place during his 2010 deployment. A military tribunal that probed the killing years ago initially cleared Golsteyn -- but the investigation into him was re-opened after he spoke to Fox News' Bret Baier.

Navy Seal Chief Gallagher, who served 19 years of his life, deployed 8 times, defending this nation in the most horrific and dangerous hell holes in the world, charged with premeditated murder of a terrorist (and take note, no matter what story you read, the heavily armed terrorist who barely survived the bombing the military ordered is now referred to as an "Afghan boy").
See, this is a real problem for our sons and daughters who serve. One minute they are encouraged to get the terrorist, kill the terrorist, bomb the terrorists, and then one survives and this gun toting murdering terrorist who lived to murder our Troops, suddenly becomes just an "Afghan boy." This reminds me of Sgt. Miller's case. At trial, the terrorist Sgt Miller pursued and killed in self defense, became just a "little old local Afghan man!"
After 19 years of heroic service, Chief Gallagher was transitioning to retirement when he was yanked out of TBI treatment, shackled and taken to the brig in California, where he remains. What is worse is what was done to his children. After his wife left for work, a swat team stormed his house, pulled his sons out of bed in their underwear at gunpoint where they were taken outside, in view of all the neighbors, while the bullies searched the Chief's house.

Whoever ordered this abuse of Chief Gallagher's sons should be hog tied and beat with a stick! What a twisted bunch of sick bullies, to do that to the children of a man who was willing to die for all of us. When you consider 19 years of service, 8 deployments, that computes to 14 years this man was away from his family to serve his country and do the bidding of the United States Military! And this is how they treat him and his children!
The Chief is charged with premeditated murder and continues to sit in a brig where I've read his food is laden with rat feces and the temperatures in the cell go from hot to cold. The military appears to be torturing this Hero. His wife and children are terrified for their father and I can just about guess the Chief's sons most likely will not consider a career in this schizophrenic military!
Who in their right mind would serve such a backstabbing bunch like this?!

This military trains our Soldiers to kill the enemy. They deploy our sons and daughters to terrorist territories all over the world, and instruct them to kill the terrorists. When they do, the terrorist suddenly becomes just a "little old local Afghan man", and our Sons suddenly become the "murderers" and charged with premeditated murder!
I love our Troops, with all my heart and soul. Men in my family served. They were willing to die protecting us. I'm so proud of their selfless sacrifice but I'm disgusted and fed up with this military.
Enough of this! The UCMJ should be diagnosed as schizophrenic, with psychotic features, and they should be tried as accessories to murder (they give the orders and they send our Troops to kill terrorists). Further, they should also be tried for torturing an American Hero, Chief Gallagher.
When they drag the latest American Heroes into court, to try them for premeditated murder, all the cards will be stacked against them. In a military court, they are guilty until proven innocent (just look at how they are treating the Navy Seal Hero Chief Gallagher) and they will be tried by a jury stacked with underlings subject to fierce career backlash if they decide against the Prosecutor. I'm familiar with one case where the entire jury had just come off a deployment with the prosecutor! What private is going to go against a Major?!!!
If he was cleared, then why isn’t he protected under double jeopardy law?

Sergeant York was guilty of murdering young German boys, one by one, in a diabolic rage of violence against these young boys who were minding their own business in their own trenches doing nothing nefarious but eating sauerkraut.

During combat operations. Even with a restrictive ROE if he believed that inaction would put fellow soldiers or civilians in imminent risk of death then he would be justified.

This particular case goes back almost 10 years, if it continues maybe ‘we’ can get JFnKerry charged with covering up rape and murder in Vietnam as he claims it was an ongoing happening while I think, that as an Officer knowing and ‘witnessing’ such goings on- Kerry should have been charged with - at the least- dereliction of duty.
It all seems like a conspiracy...start charging the virile young men with these ‘crimes’ and the virile young men will quit enlisting and it opens the ranks to the Females, fags, fairies and sexually ‘confused’.

You raise an interesting and quite relevant point. Although I have active duty experience, am not deeply familiar with UCMJ or JAG policies and procedures.
Wonder if it is possible for the defense to obtain a jury composed to some degree of former or ex active duty personnel (no one would want pure civilians) - in an effort to avoid harmful influence? Especially, for career-ending charges?
