CNN asks for emergency hearing after Trump threatens to revoke Acosta's press pass again

CNN) The White House has issued a new warning to CNN's Jim Acosta, saying his press pass could be revoked again at the end of the month.

In response, CNN is asking the U.S. District Court for another emergency hearing.

"The White House is continuing to violate the First and 5th Amendments of the Constitution," the network said in a statement Sunday. "These actions threaten all journalists and news organizations. Jim Acosta and CNN will continue to report the news about the White House and the President."

Last Friday CNN won a temporary restraining order, forcing the White House to restore Acosta's press access to the White House for 14 days. Judge Timothy J. Kelly ruled on Fifth Amendment grounds, saying Acosta's right to due process had been violated. He did not rule on CNN's argument about First Amendment violations.

Later that same day, the White House sent Acosta a formal letter outlining a "preliminary decision" to suspend his pass again once the restraining order expires. The letter cited his conduct at President Trump's November 7 press conference.

The letter was signed by two of the defendants in the suit, press secretary Sarah Sanders and deputy chief of staff for communications Bill Shine.

The letter signaled that the Trump administration wants to continue fighting Acosta, despite the round one setback in court, rather than seeking an out-of-court settlement.

When one goes to a Judge for the redress of grievance one had best be prepared to wait a LONG time for “justice”.

So the judiciary thinks it can issue executive access?

Maybe the president should issue an injunction on this judge.

The 1st and 5th Amendments do not apply to press passes.

It’s just like having a driver’s licence isn’t a “right”.

CNN has something like 50 White House hard-passes for reporters and support personnel - only one of them is being revoked.
One out of 50 - how is that infringing on the free press?

Judge all ready ruled against them on their fraudulent claims for 1st Amendment protections. Instead he manufactured a fraudulent due process claim to keep from having “The Press” attack him

CNN has no leg to stand on here. Just clown grandstanding on their part but don’t be surprised when this gutless coward pretending to be a Judge manufactures a new excuse to kiss CNN’s ass.

Acosta now has a huge incentive to create a big stink at every presser.

Any publicly owned company can decide who they want in their building and who they don’t.
Try walking into Google or Apple and the response will be “Who are you here to see and they will need to sign you in”

I guess we can all just walk into CNN HQ when ever we want.

If Acosta acts out again, PDJT has only to say, “have him removed”.

Acosta being dragged out kicking and screaming would be some truly dynamite entertainment.

Right now the judiciary has dictated that the White House must have rules of conduct in place and show cause for revocation of participation rights. That’s bad enough. But if the judiciary takes this further and starts imposing their own rules on who can and cannot be at briefings, were I the President I’d declare that since I can’t control the proceeding and I don’t know the rules anymore, in order to avoid potentially violating them there will be no more open press conferences. Please direct any concerns or complaints to the CNN legal team.
