NEW YORK (AP) Whatever success Republicans have amassed in taking control of all three branches of U.S. government, and whatever fate awaits them as midterm elections near, some on the right are working to cement change by amending the Constitution. And to the mounting alarm of others on all parts of the spectrum, they want to bypass the usual process.
Theyre pushing for an unprecedented Constitutional convention of the states. While opponents are afraid of what such a convention would do, supporters say it is the only way to deal with the federal governments overreach and ineptitude.
They literally see this as the survival of the nation, said Karla Jones, director of the federalism task force at the conservative American Legislative Exchange Council, which represents state lawmakers and offers guidance and model legislation for states to call a convention under the Constitutions Article V.
Among the most frequently cited changes being sought: amendments enforcing a balanced federal budget, establishing term limits for members of Congress, and repealing the 17th Amendment, which put the power of electing the Senate in the hands of the public instead of state legislatures.

Those recommendations are STATUTE LAW, as are with most people would request Preferences.
Must stick to Constitution type amendments, such as, permanently returning to a Republic, by cancelling the Amendment 17.
A17 created a Super House of 535, and disbanded the Senate.
People already had representation, but State representation must be returned.

It’s not a Constitutional Convention; it’s a Convention of States, as provided for in Article V, Different thing.
An Article V convention can be limited to the subjects listed when it’s called, and since it’s a method for amending the Constitution provided for in the Constitution (although so far never used), all it can do is propose amendments. They still have to be ratified.
If it exceeds its authority and proposes anything really radical, it can be defeated by the state legislatures.
Yes, AND the COS can lock that into place for when we lose Congress.
Try getting them through Congress.

I’m glad the states are getting serious about this.
There will, however, be a snag when it comes to balancing the budget — nearly impossible for congress to survive a major and instantaneous hit on social security. It would be easier to whack federal pension plans. But I’ve seen no will to do that either.
We need to finesse the budget down, like I’ve been saying. A systematic counter-pressure.
I worked one out, but so far people are determined to be arbitrary. Easier on the brain I guess.

Never get 38 states to ratify even if they get 34 to agree to call for a convention.

There will have to be some give-and-take. We’re not going to be able to control it. I don’t want to give them anything.
The states will send delegates, not representatives. Unlike our House of Reps which recognizes no bounds, state delegates will have detailed commissions.
Here, for instance, is the Indiana statute that will govern the commissions of her delegates to an Article V convention. The implication that state legislatures will send lunatic delegates with plenary authority to take away unalienable rights is just silly.
