President Trump said Wednesday hes still committed to ending birthright citizenship for babies born to illegal immigrants, but would prefer to go through Congress rather than use an executive order.
Thats a softening of his stance from an interview published Tuesday, where he told Axios, an online political outlet, that he was preparing an executive order to test the boundaries of the Constitutions definitions of automatic citizenship.
Mr. Trump, who during the 2016 campaign had called President Obamas executive actions on immigration unconstitutional and illegal, also cited those as precedent for his own plans.
If he can do DACA we can do this by executive order, the president told reporters as he prepared to jet to Florida for a campaign rally.
Mr. Trump said curtailing birthright citizenship was much less complex than some were making it out to be.
Id rather do it through Congress because thats permanent. But we can certainly do it through executive order, he said.
His suggestion of tackling birthright citizenship has drawn opposition from those both inside and outside the GOP, with House Speaker Paul D. Ryan shooting down the plans on Tuesday.

8 USC Section 1401 repeats the clause “Subject to the jurisdiction of thereof”, but does not define the meaning of this clause and simply codifies the history of the significant accepted exceptions. The courts will defer to the law, before they address the Amendment itself, so the law needs to be clear. This is a tactical issue, not a legal issue.
At least the conversation has started. It doesn’t even make sense that 9 months pregnant women, who are NOT from here, come rushing into our country and charging our borders, to give birth and are then “rewarded” with their babies being citizens, even though they are not? Insane.
I don’t know...about art of the deal....he could do executive order and let congress back it up forcing them to action actually reinforcing 14th. But he backed down so quickly like he did on releasing the info weeks ago identifying the sedition leaders in DOJ and FBI. He under cut us there and this election would IMO be a cake walk now if he hadn’t backed down on that. Don’t know who’s advise he is taking BUT when he goes south we get F _ _ _ _ _!!!!!!
IMO, you are essentially correct; although 1401 doesn't say a word about anchor babies. Nor does it change the original intent of the 14th (as it could not since it was not an amendment).
Section 1401 simply resolves a few unforeseen operational issues that had developed over time and expressly adds specific populations that were covered by the 14th: Indian, Eskimo, Aleutian, or other aboriginal tribe
There simply is no evidence, particularly in the language of 1401, that Congress intended to redefine the "jurisdiction" element of the 14th by also including onsite-born children of illegal entrants.
The only way to get to that conclusion, of course, is to adopt the globalist definition of "subject to the jurisdiction".
He can try to do it by EO, and the Court would decide if it’s lawful. I believe it is.
With Congress, the price will be amnesty and loopholes. Failure.

Trump has every reason to have more confidence in the USSC supporting his interpretation of the Fourteenth Amendment than could ever be placed in the feckless US Congress.
Trump can split the Republican caucus after the election. And he can issue his EO then, whether is a GOP or Dem House.
That is in no way a “surrender”.
That’s not a smile - it’s gas and indigestion because Ryan realizes that Trump will end up having his way...
