The gunfight happened in the early morning hours of 17 August 2018. The location was 867 Bootlegger Lane in Yoakum, Texas. Yoakum is a small town in Texas, about halfway between San Antonio and Houston.
There was bad blood between Dakota Wayne Kirkman, 19, and Manuel Martinez III, 36. The men lived about 22 miles apart. Yoakum is in DeWitt County, Texas. Kirkman and his girlfriend lived in Hallettsville in Lavaca County, Texas.
Dakota did not want his live-in girlfriend to hang around Martinez and his wife. His girlfriend, Martinez, and Martinez' wife were at Martinez' house when Kirkman came to bring his girlfriend home. Kirkman arrived in his truck. He had a singleshot .22 rifle and one cartridge, loaded in the chamber.
Kirkman and Martinez got into a verbal altercation. The Sheriff reported that alcohol was involved.
The altercation escalated into a gunfight. Cartridge cases found at the scene indicated that Martinez fired 15 shots from an AR15 type rifle and 12 shots from a .40 caliber pistol.
Most of the action seems to have happened while Kirkman was in or around his truck. 13 bullet holes were found in the truck. 11 of the bullet holes were from .223 cartridges. Two of the bullet holes were from a .40 caliber pistol.

Correction: Kirkman not Yokum.
He had a .40... it begins with a "4".
Black humor aside, it is a very sad situation.
All too common with young men, women, and alcohol.
That was taken from the old Maxim:
“Beware the man with one gun, for he surely knows how to use it.”
hope he ditches the GF sounds like she is BADDD news..
Taking a shot at a guy the middle name of Wayne isn’t going to end well. Especially for a guy who can only hit a truck 13 out of 15.
“alcohol was involved”... ..
A given!
Also a case of youth meeting age and coming out the worse for it!...
Could it be that “sober” versus “intoxicated” might have made a difference? No Doubt!
Nasty situation all around.
One report claimed that Martinez wife/girlfriend (not entirely clear) is the sister of Kirkman's live-in girlfriend.
I do not know if it is true. The names of the women have (correctly) been withheld.
Killing your girlfriend's sister's husband is not good.
Kirkland survived.
As others have noted, no winners in a gunfight, only survivors.
If you ever go to Yoakum, Texas, stay off of Bootlegger Lane.
That’s what I always say.
If Marty Robbins were still around, we might get a nice song out of this.
So, size DOESN’T matter.
There’s hope for me...
Oh no, size matters...
(insert dirty jokes here)
I bet the deceased ran out of ammo and was shot while trying to reload.
I considered that.
It was dark. Maybe the survivor scooted 20 yards away, under cover of the truck, and gingerly looked for Martinez from behind a tree. Then fired his shot when he saw Martinez back-lit by the porch light. Pure speculation, but tactics beats caliber, and strategy beats tactics.
Strategy in this case would have been to avoid the place altogether.
But men do crazy, stupid stuff when women are involved. Alcohol makes it worse.
I bet he’s a hunter and uses that 22 for squirrels and such. Never, ever get into a gunfight with someone who learned at the age of 10 how to hit a moving target 100 yards away.
Which is a rephrasing of the even older, “Beware of the man who only reads one book for he will know it from cover to cover.”
The first time I heard this phrase it was in respect of a man who only had one fire arm but used it for all events in which a firearm was required.
The best gun in a gun fight is the one used by the better shooter.
Sun Country pilot arrested with loaded gun at Florida airport; his Minnesota permit to carry not recognized
Police say his Minn. permit to carry not recognized by Florida.
My thought as well. A man is a big target for a squirrel hunter.
A hunter knows anatomy well.
A hunter does not aim for the squirrel.
A hunter aims for that part of the squirrel he wishes to destroy.
A hunter thinks of his prey in three dimensions so as to destroy the part he wishes to, without damaging too much meat.
A hunter is half-way to being a warrior.
Prowess in hunting and war have been linked forever.
This from Rudyard Kipling:
They'll drink every hour of the daylight and poach every hour of the dark.
It's the sport not the rabbits they're after (we've plenty of game in the park).
Don't hang them or cut off their fingers. That's wasteful as well as unkind,
For a hard-bitten, South-country poacher makes the best man- at-arms you can find.
