Newly seated Justice Brett Kavanaugh spoke up Wednesday in defense of the Trump administrations view that legal immigrants with criminal records can be arrested and held for deportation, even years after they were convicted and completed their sentences.
At issue is a federal law that calls for mandatory detention and possible deportation for criminal aliens, including legal immigrants convicted of crimes ranging from violent felonies to simple drug possession. The law says the Homeland Security secretary shall take into custody any alien with a criminal record that could lead to deportation when the alien is released.
The debate focuses on when exactly is when?
In a class-action suit brought in California, lawyers for the American Civil Liberties Union complained the mandatory detention policy has been applied to lawful immigrants who had lived and worked in the community for decades after being convicted of misdemeanors, such as drug possession charges.
The administration argues that a provision of the 1996 law calls for arresting and jailing such immigrants, despite their good records after serving their time....

This is not even an issue except for those traitors in the ACLU. Im sure not one of the ACLU directors would even house one of the illegals in their own homes.
They aren’t “legal immigrants” just because they’ve been here a long time.

Excellent. Kavanaugh will be an improvement. Change the law seems to be his constitutionalist viewpoint over and over...I like it.

One prediction I made early on if Kavanaugh was confirmed to the court was that we will be seeing less cases from the ACLU.
For years they have used the courts to get things they could not get by the legislature. With a left leaning court they stood a good chance of wining so it was worth the time, effort and money to get a case to the Supreme Court.
It is not longer a sure thing. And they understand that if the Supreme Court rules against them it stands nation wide.
It will be up to conservative organizations to go after “settled law”.

They are legal residents, not citizens. To me a legal immigrant is someone who has completed the citizenship process.
“At issue is a federal law”.... Well alrighty then. That explains it. There is a law. Kavanaugh will follow the law. Tis not the job of the judiciary at any level to create their own laws, as has been going on for the past 8-10 years.
I hope Judge Kavanaugh realizes (if he didn’t already) just how vile and destructive the left is, and that their evil agenda must be defeated in every way possible at every opportunity.
I don’t know the details. If they didn’t follow the process
as specified then they should go.
While my feeeeeelings are that it’s harsh to get jacked over a misdemeanor, the law is the law. Who knew going to another country and committing crimes would get you thrown out?
And as to the “decades” part from the example, my parents came here, committed no crimes, and gained citizenship as soon as the minimum five years were up.
