Democratic Senator Merkley is filing a lawsuit over the Kavanaugh nomination and seeking an injunction on a confirmation vote. He argues the White House has violated the separation of powers by obstructing the Senate's investigation (by withholding documents, for example.)

RIIIIIGHT, because the Judiciary interfering in the Senate’s rules is NOTHING like overstepping Separation of Powers.
The Senate would be well-advised to simply ignore such a judge’s ruling.
He knows some whack judge in Hawaii or California might actually entertain this.
Merkley is truly a sorry excuse for a US Senator, nuttier than squirrel dung.

They have done salted earth politics for decades now, it has just taken many of us too long to accept it.
Dan Bongino has a great view on this, he likens it to a boxing match where the opponent has taken padding out of his gloves, or put razor blades in them, and when we find out, we appeal to the ref who shugs his shoulders and says “I don’t see nuthin.”
He thinks that we have politically come to the point where we stop appealing to the ref, which is the first step to accept what is going on and begin really combating it.
