A grand jury in Texas returned a felony indictment against a man accused of grabbing a MAGA hat from a teen’s head at a San Antonio Whataburger in July.

Police arrested 30-year-old Kino Jimenez in July after he allegedly assaulted a teenage boy in a San Antonio Whataburger. The man was seen in a video that went viral, accosting a group of teens because one of them wore a hat showing support for President Donald Trump, Breitbart Texas reported. As the video begins, Jimenez allegedly says, “… supporting the president.

I agree that what he did was criminal. But not a felony. Even if pled down to a misdemeanor, he will be ruined for life. No one should be ruined for life for an emotional outburst with no sequelea

Former Texas LEO here. “Theft from a person” is a Texas felony. This includes pickpocketing or even removing something held or worn by someone in an act of theft, even if the item is worth pennies. It is just short of robbery.

If an injury or justifiable fear of injury occurs in the commission of the theft, it IS robbery.

Bottom line is that people need to live their lives doing the right thing. Stealing property from someone else is wrong. It’s not like the “jerk” here was ten years old; he was a full-blown adult doing the wrong thing and he knew better.

And... the law is the law. If it’s a problem, then you need to run for office and work to have the laws changed to make it OK to steal from others. Easy peasy.

I Also noticed the word ‘alleged’ seems to be just reserved for dem. If you’re a conservative they use only words which already have you condemned to the gallows when there’s a whisper of an accusation.

I think it’s a felony due to the age of the victim. Also, if the victim were over 68 I believe the charge would be the same.

I actually got a cold shiver thinking of all the guys I knew, who graduated between 1970 and 76, with whom it would have bee suicidal to to act that way...even if they were alone. Im talking about guys who DID kick the crap out of guys like this.

What the man did was wrong, but not a felony wrong.

The reason the law was in place was to keep the young man or his family from hunting this man down and beating him or killing him out of anger.

The Leviathan is in place so that society behaves itself and doesn't take the law into it's own hands.

If someone were to come up to me in my youth and in my old neighborhood doing what he did. His arms and legs would have been broken with a crowbar by my cousins. No cops would have been called and the "grabber" would be reminded daily for the rest of his life that he made a mistake.

I know this to be a fact because a young man pushed my grandfather down and he broke his arm while waiting for a bus when I was 6-7 years old. The young man was found in the middle of the street with all four extremities bent in the wrong manner and my grandfather was able to use the bus stop and walk around our neighborhood till he was in his 80's without fear of thugs.

This clown with man-boobs is a bully. He will more than likely be convicted of a felony. That's not a good thing ever to have on a resume, especially in Texas and especially when an employer looks at the particulars of the charges. He should move to Austin or California.

I don't like bullies. They need to be beaten like a rabid dog and taught to behave.

I hope to be visiting Texas in the next few weeks or so, Lord willing. I’m hoping for some Whataburger and yes, my first In-and-Out.

Whataburger is real good eatin. You'll love it. In 'n Out will also put a smile on your face. It's just good honest food.

Of course he was wrong.

But there has been a creep upward in what felonies are these days.

over the past 40 years relatively mild infractions have been added as felonies. One would have been laughed out of court for some of the crimes charged as felonies now.

Don’t be bad is easy to say. But in the world, life happens and life is hard which is why stupid things like trumped up charges for minor infractions are more totalitarian rule.

I have no problem with having the man arrested, tried and convicted.

it is the FELONY charge that I object to. This is not felonious behavior. This is misdemeanor behavior.

We have weaponized the judicial system to the extent that it is a danger to the populace.

In reality, there has been a dumbing down of the law.

Burglary of a vehicle used to be a felony, rightfully. Now it’s a misdemeanor.

The values required for theft to be a felony have steadily risen, much more than the rate of inflation.
