Dont know about NM. But if I were the judge, I’d give him a year in the local county jail under the Huber law and the max probation after. That way he can pay the going rate for staying each night at the “hotel” they got there.

In Wisconsin, its as much as 20 bucks a night in places-usually 15 a night.

If he doesnt have a job, then the max in the state pen.

Let’s get realistic here.

It was assault and battery (maybe on the battery, my understanding of the legal definition is limited).
If the kid was a minor, then the assault charge gets more severe.

He’s not a terrorist. This level of assault, while committed for very deranged motives, does not rate a year in jail. 90-180 days in the county slammer is legally justified with a year probation after.

I’m outraged at this stuff, but if punishment as I suggest is meted out consistently every time they do this, trust me, they’ll stop.

Problem is that little or no punishment is ever levied on these people.

Seems like more than theft happened here. How can you throw a drink in someone’s face, and have it caught on video, and not get charged with something tougher than theft?

I wonder what penalty someone would get if they snatched the gavel from the judge’s bench, threw a drink in his face and then exited shouting he would burn the gavel.
