Emoluments Lawsuit, Accusing Trump of Violating Constitution, Clears a Hurdle

A lawsuit accusing President Trump of violating the Constitution by maintaining a financial interest in his company’s Washington hotel cleared a critical hurdle on Wednesday when a federal judge allowed the case to move forward.

The plaintiffs in the lawsuit, the District of Columbia and the State of Maryland, say that Mr. Trump’s profits from the Trump International Hotel, just blocks from the White House, violate anti-corruption clauses in the Constitution and take business from local convention centers and hotels. The Justice Department argued on behalf of Mr. Trump that the clauses, which restrict government-bestowed financial benefits or “emoluments” to the president other than salary, do not apply to his interest in his hotel.

Judge Peter J. Messitte rejected the Justice Department’s request to dismiss the case, writing in a 52-page opinion that the president’s attorneys were essentially arguing that absent evidence he had accepted a bribe, Mr. Trump was free to accept financial benefits stemming from foreign or state officials who patronize his hotel.

Idiot judge, appointed by Bill Clinton doesn't care about the law, just try to get Trump.

Judge Messitte was nominated as a United States District Judge by President Clinton on August 6, 1993.

well that's the complaint, isn't it? The State isn't losing any money - it doesn't matter which hotel the room-tax comes from. However, Trump developed the hotel on assurances from the Federal Govt (the landowner) that a hotel was appropriate for that location. That of itself seems it would be hard to argue against.

Only people whose only source of income has been from bellying up to the feral government trough are eligible to be President.

“On August 6, 1993, Messitte was nominated by President Bill Clinton to a seat on the United States District Court for the District of Maryland vacated by Joseph C. Howard, Sr. Messitte was confirmed by the United States Senate on October 18, 1993, and received his commission on October 20, 1993. He assumed senior status on September 1, 2008.”

Senior status means that Trump will get to replace him.

And a DC citizens group is trying to get the hotel's liquor license revoked because "the owner (Trump) is not of good moral character."

Of course, foreign officials dumping monies by the millions and millions into your pretend charitable accounts via American businesses that you actually use for your Presidential campain DOESN’T influence your decisions if you win, right?

This case could make a good president for nailing killery down the road.

Trump cannot remove a federal judge from the bench, that can only be done through impeachment and conviction.

And those are much rarer than hens teeth. Of the tens (or even hundreds) of thousands of federal judges one has been removed. This distinction belongs to Elcee Hastings, Congressman.
