Democrats: Kavanaugh must say how he'll rule on abortion, healthcare

Democratic senators said Monday that Judge Brett Kavanaugh’s past willingness to take positions on decades-old Supreme Court cases means he must also be forced to answer questions about how he’d rule on abortion and health care cases.

At stake is the standard senators will use when questioning Judge Kavanaugh, President Trump’s nominee to the Supreme Court, during his confirmation hearings, and in confirmation votes.

Republicans have said Judge Kavanaugh should decline to answer questions about cases that could come before him on the high court, calling that the “Ginsburg Standard” used by liberal icon Justice Ruth Bader Ginsburg to deflect questions during her confirmation hearings.

But Senate Minority Leader Charles E. Schumer said Monday that Judge Kavanaugh hasn’t been shy about offering his opinions on major cases even while serving for the last 12 years as a judge on the Circuit Court of Appeals in Washington, D.C. — and senators shouldn’t let him start clamming up now.

Mr. Schumer’s major piece of evidence is a 2016 speech Judge Kavanaugh gave to the American Enterprise Institute disagreeing with a 1988 Supreme Court ruling upholding the Independent Counsel Act.

You know what’d be funny?

What if he said, ok. I’d vote to overturn Roe v Wade.

But somehow McConnell had gotten two D’s already to replace the two lib R’s.

That’d actually be hilarious.

Uh, too bad so sad. More proof of their idiocy. How could he give an answer with any merit on a generalized question anyway. Non specific questions equal no answer.

Kavanaugh, if pressed on the abortion issue in committee, needs to say that he has no preconceived idea of how he’d vote on a case - especially one that is theoretical in nature.

He could go on to say that if such a case makes its way to the Supreme Court, he’d review it as he would with any other case and make a judgement based purely on the legal merits of the case and not on pressure group opinion.

These hearings have devolved into a circus.

Days and days of preening by Schumer and his people?

I heard that in 1962, the hearing for Byron White took 20 minutes. In an era before cable news networks having airtime to fill, there was no desire for people to grandstand during supreme Court hearings.

Sound about right.

Democrats want judges who have their minds made up, one way or the other, about cases in front of them or yet to come in front of them.

Great judicial system they want.

It’s like the same kind of judgment they’ve already made regarding the phony collusion issue, where they all are already convinced that Trump colluded with Russia to steal the election from Hillary. Why even have judges when the judges must rule according to what the democrats want?

No he doesn’t.

In fact, decorum says he cannot comment on any case not before him and even then remain mute until rendering a official decision.

No judge should EVER opine on a hypothetical case.

I hope K is too smart for this kind of small-fry politics.
