I think you've got the wrong Supreme Court case in mind. I'm referring to the original decision in 2012: National Federation of Independent Business v. Sebelius. I believe you're citing Scalia's dissent in King v. Burwell (2015).

I’m not a fan of Kavanaugh, but the reality is the GOP has a slim margin 51-49 in the senate and we know at least three or four of them are not dependable. Trump made a safe pick in Kavanaugh who will probably be confirmed. Not really happy with this pick, but with idiots on our “side” like Murkowski, Collins, Graham and McVain I guess this had to be! Purely a political decision by the president to pick Kavanaugh!
