Senate Majority Leader Mitch McConnell defended himself Thursday evening against claims that he is being hypocritical by pushing to confirm a new Supreme Court justice before the upcoming elections.
After Justice Anthony Kennedy announced his retirement, McConnell said on the Senate floor that legislators "will vote to confirm Justice Kennedy's successor this fall," which prompted an outcry from Democrats, who accused the majority leader of hypocrisy for not waiting until after the elections as he did when former President Barack Obama nominated Merrick Garland in 2016.
"Sen. McConnell set the new standard by giving the American people their say in the upcoming election before Court vacancies are filled," Democratic Minority Whip Dick Durbin said in a statement, according to CNN.
"With so much at stake for the people of our country, the U.S. Senate must be consistent and consider the President's nominee once the new Congress is seated in January."
"What I said in 2016 is that we shouldn't fill a Supreme Court vacancy in the middle of a presidential election year. The last time I looked, there's no presidential election this year," McConnell said on Fox News Thursday.
"And, in fact, three current members of the U.S. Supreme Court were completed in election years, non-presidential election years. And the president's nominee to the Kennedy vacancy will be confirmed in a non-presidential election election year," he added.

Just look what they are saying about Kennedy when he retired.
FDR attempted to pack the Supreme Court with an additional justice for each sitting justice aged 70 or over, for a total of fourteen. The bill in Congress seemed to be on its way to passage when the Court made two decisions in favor of New Deal programs and one of those was by a majority including the youngest justice (aged 60).
“A switch in time saved nine” went the joke. The bill lost steam & was tabled.
Any court packing attempt today would require a President of demonic charisma to push it through Congress. Attempting to shift the Court’s ideological makeup in this fashion would be so obvious as to doom it from the outset, IMO.
I.e., first the Left has to GET back into power. They are not inevitable.

yes, to these leftists,there is no scorecard, no balance sheet as such, to say that someone has done great things for them in the past.
No question if there were such calculus on the left, they would praise Kennedy for his decisions which supported their causes. Instead, there is only scorn because he had the audacity to retire at this point.
There are elections every two years FCOL. So every other year we are supposed to wait until after the election to confirm judges ... (that is when Republicans are in charge)?
Don’t fall for that limitation, Mitch! If an opening happens in 2020, confirm him! The limitation is that if the opposing party controls the Senate, it is fair to not confirm an appointment in the election year of a president. If the President and the Senate are of the same party, there is no reason to wait.
