Border Patrol detained undocumented mom on way to S.A. hospital

An undocumented mother of four from Laredo was detained Sunday by U.S. Border Patrol agents in San Antonio as she brought her 4-year-old special needs son, a U.S. citizen, into University Hospital for orthopedic surgery on his broken arm.

San Antonio attorney Gerardo Menchaca said Monday that the woman, Silvia Macuixele, originally from the Mexican state of Oaxaca, was detained and fingerprinted at a checkpoint north of Laredo on Interstate 35 as she brought her son north by ambulance. Agents then followed the ambulance to San Antonio shortly after 3:30 a.m. Sunday.

Menchaca said “an incredibly nice” agent stayed with Macuixele, who was not in handcuffs, when she arrived at University and then remained in her son’s room even as she conferred with her attorney, despite Menchaca’s protests. She was prevented from contacting her family or leaving the hospital room, and then was taken back to Laredo with her speech-impaired son by agents and not released on her personal recognizance until early Monday.

The federal agency had been informed by a Laredo hospital that Macuixele, who had been twice deported in 2008, would be in transit in the ambulance, said Priscilla Martinez, the immigration coordinator for Workers Defense Action Fund, an immigration advocacy group that assisted the mother and alerted the media.

A statement released Monday by the Border Patrol’s parent agency, U.S. Customs and Border Protection, said Macuixele is to appear before a federal immigration judge, possibly in May, who will rule on her immigration status and determine her eligibility for relief or removal from the United States. Martinez said Macuixele has reported to law enforcement incidents of domestic abuse by an ex-husband in Laredo and might seek a visa accommodation due to that.

I am assuming yes. Meanwhile Mississippi is closing 80 + unsafe bridges. I believe that no Mexican wants to be on the hook for my medical care.

It used to be that American seniors went to Mexico to get treatments they couldn’t afford in the USA. I hear that business is seriously down since drug gang turf wars and kidnappings are up.

I swear the cops think that if you are on the road that late you are either drunk or up to no good.

Amen to that! We had to take our dog to the 24-hour vet clinic late one night and started home about 2:30 in the morning. Although we were never stopped, we had a discreet police presence all the way home.

They left when they saw us unloading the dog :)

That's because it's true.

The admonition I gave my teenagers when they wanted to stay out late was, "All of the bad stuff happens between midnight and 5 AM."

She would be thrown in jail for two years and deported, if the second time, she would get ten years in prison and then deported.

I vote for the fee no money transfers, because the money comes right out of the pockets of those who are abusing our border. Having the “governments” of these countries pay up in some fashion let’s them think that it’s o.k. to continue to send their “unwanted citizens” to the US.

So some illegal can simply claim that "someone" abused her, and then garner special visa accommodations as a consequence? Un-f*cking-believable!

True. I agree with you. I’m just saying that those that get off work at that time are an innocent minority. But they are a minority.

I didn’t mean to. I’m basically arguing that it is a reversal of the rest of the day. During the day, most people are just driving to the store, to or from work, to a friends house, piano lessons, a restaurant, etc. But a small minority is coming home from a four martini lunch, a drug deal, etc.

After midnight it’s the opposite. That is what I meant by “innocent minority”.

And I didn’t mean to suggest you meant that EVERYBODY out after midnight is a troublemaker. It’s the limited communication capacity of typed words only on the internet that is confusing things.

That and this site doesn’t support smileys very well. :)

I'm an old guy who lives on a farm. Gets pretty boring day-after-day just watching the cows graze. Old guys are always up to no good. Being sarcastic is a given.

Seriously, the last time I was up past midnight, I had to drive to the airport to pick up my wife. She likes to fly the red eyes in the middle of the night because the planes are empty and the fares are cheaper. And the guy who comes to pick her up works for nothing. Somehow, I always draw the short straw.

That's my story and I'm stickin' to it. Have a good one. :-)
