I’m not going to obey these unconstitutional judges or any unconstitutional laws they attempt to impose on me.

To Hell with them.

I have quite a few rural relatives in MA. It's a very distinct possibility that every one of the them has at least 1 AR and a large box of magazines. It's also possible that their close friends in MA who happen to be local and state COPS also have a fine collection of the same. The state govt is operating in the "Emperor has no clothes" world of blissful wonderment thinking they own the people. Fools.

In reality U.S. District Court judges are selected by the state’s U.S. Senators and then nominated by the President unless there is something extremely bad in their background. It’s one of those unwritten rules of the Senate that needs to go away.

The guy should be impeached.

... assault weapons and large capacity magazines banned by the state in its 1998 law fall outside the ‘‘scope of the personal right to ‘bear arms’ under the Second Amendment.

The hell they do!

Not a good thing right now. Trump needs to get two picks replacing liberals on the court.

SCOTUS will deny cert and that will probably be the conservatives denying it because they know they can’t get a favorable outcome.

Doubt your premise quite strongly as the current SCOTUS has ruled against more onerous legislation than this.

These types of cases have already been decided in DC vs Heller. Who is it that is going to enforce the law? DOJ needs to go after these judges and states for violating our civil rights.

Maybe he just wants to kick it to the SCOTUS.

And just like the challenge to the Maryland AWB, SCOTUS will refuse to review.

Yes SCOTUS has ruled against more onerous legislation.

Because this legislation is less onerous than what they’ve ruled against before, they’re less likely to rule against it. Further, a favorable ruling requires getting Kennedy to side with conservatives and an assumption that whoever blackmailed Roberts over Obamacare doesn’t pull his strings again.

I am not willing to gamble the survival of the republic, American freedom, and the rights of the people of Massachusetts on Justice Kennedy’s mood swings.

Fine, then television falls outside of the scope protected by free speech. Let’s draw imaginary lines based on nothing and call it “scope”.

We should just be glad we’re allowed pea shooters and sling shots.

You better keep your Assault Slingshot out of New Jersey, bub.

Let see if the same legal standard is applied to the various Abortion bans states have recently enacted.

“assault weapons and large capacity magazines banned by the state in its 1998 law fall outside the ‘‘scope of the personal right to ‘bear arms’ under the Second Amendment.’’

Really? Where is it written that only certain guns are allowed under the 2n’d amendment?

this puts people in a catch 22 situation- they don’t obey the law, get investigated and found to have a banned gun- it makes them an instant felon- and felons can’t ever own guns after being found guilty- so we go from law abiding citizen to instant felon who are prohibited from ever legally owning a gun again

The left are slowly eroding away our 2n’d amendment right- (Although they can’t erode our inalienable right- but now, in order to abide by our inalienable right, we are labeled felons)

I believe they refused to hear the case in NY of them violating constitutional rights too if I’m not mistaken

Actually, Scalia, in his opinion in Heller, left open the means for precisely this kind of ban. I always wished that Thomas had written for the majority, I think it would have been a better decision.

"Although we do not undertake an exhaustive historical analysis today of the full scope of the Second Amendment, nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms." (emphasis mine)

Actually I meant less onerous and Kennedy has ruled consistently in favor of the 2nd Amdt.

If our Congress gave a damn about our rights as citizens, they’d file impeachment charges against this monster today.
