Cochran to resign from Senate next month

Sen. Thad Cochran (R-Miss.) on Monday said he will resign from the Senate next month, saying his "health has become an ongoing challenge."

"I intend to fulfill my responsibilities and commitments to the people of Mississippi and the Senate through the completion of the 2018 appropriations cycle, after which I will formally retire from the U.S. Senate," Cochran said in a statement.

He is set to resign from his seat on April 1, according to his office.

Cochran is the chairman of the Senate Appropriations Committee. His announcement comes as Congress aims to pass a mammoth government funding bill by March 23, and after months of speculation about his health.

I believe the special election will be Nov. 6, the same day as the Wicker seat.

Now Chris McDaniel may be tempted to switch to run in a special election for the Cochran seat, which does not expire until Jan. 2021.

Mississippi FReepers can correct me if i’m wrong, but I believe the vacancy will be filled in November’s general election — the same election in which GOP establishment Senator Wicker runs for re-election.

Mr. Cochran’s retirement means that Gov. Phil Bryant, a Republican,
will have 10 days to appoint an interim senator. A special election
would then be held on Election Day in November to fill the rest
of Mr. Cochran’s term which is ends in 2020.

If an Alabama Senate seat can fall to the Democrats, a Mississippi seat could also be seized by the Democrats.

Because Mississippi has a two-term lifetime limit, the Governor is ineligible to seek a third term in 2019.

Hmmmm. wonder if he can appoint himself.

According to this link, Mississippi calls for a special election within 100 days unless in an election year (as this is), when the election is deferred to the regular election in November. The Governor still appoints an interim Senator.

We will need this interim appointment, since the Senate is currently 51R - 49D. Cochran stepping down will make it 50-49 for the interim until a replacement is named.

Ala. Code 36-9-7 et seq.
On such a day as the governor may direct, unless vacancy occurs between 2 and 4 months before the next regularly-scheduled general election, in which case it is held at that election. If vacancy occurs within 60 days of the next regularly-scheduled general election, a special election must be held on the first Tuesday after 60 days have elapsed since the vacancy occurred.

Gotta have a special election.
Gov can appoint interim Senator to serve until the election.
So, no chance for the Gov to make out here.
