But the attention to the Second Amendment is misplaced. What neither side in the gun debate seems to realize is that at the moment, when it comes to the sort of restrictions that lie within the zone of possibility, the Second Amendment is neither an obstacle nor a protection. Its an irrelevance.
Federal laws regulating guns have been around for a long time, including age requirements for gun owners, a prohibition on felons and a mandatory background check for purchases from a licensed dealer.
These rules predated the Supreme Courts momentous 2008 decision striking down the District of Columbias complete ban on handguns. It was the first time the court had ever ruled that a gun control statute violated the Second Amendment. The court said individuals have the right to own guns for self-defense, a right not limited to those serving in a militia.
The decision might have been the death knell of every firearms restriction on the books which could be regarded as an infringement on the right of the people to keep and bear Arms.
That is not how things have worked out. In concluding that Americans have the right to keep guns in the home for self-defense, the court was careful not to categorically reject all regulation.

Trib never disappoints. Always in left field & convinced the NRA is smuggling handguns to the streets of Chicago.
They stopped in the National Archives Rotunda to view the original Constitution. Holliday, using her high-pitched Queens accent, peers at the document and reads out loud to Holden only one line:
"The right of the People to keep and bear arms SHALL NOT BE INFRINGED."
How far this country has fallen since 1950.
Irrelevant and Constitution should never be in the same sentence.
Was she in a sleeveless dress?
Yeah, it’s an old joke.
(its not a barf alert but a volcanic mega barf alert)
Chicago Tribune is irrelevant. Except for Kristen Mcqueary and John Kass it is a dog potty training aide.
Only certain Utopians are allowed to have guns, use a private server for official business, surveil the political opponents during an election And generally ignore the laws of the land.
The other day I debated someone on Facebook about gun control and I simply pointed out to her that if firearms laws (or lack thereof) were a factor in crime and violence, I’d expect Vermont and Maine and New Hampshire to be among the most violent areas of the United States and Chicago and DC to be among the least. In a way, I could tell that that kind of stopped her at least.
Oh no no no ! The author is partially right, if but for the wrong reasons !
HEAR ME OUT ! You’re gonna like this one.
He is correct that the right has been destroyed already. It has ! The government is derelict in it’s duties to the US people, and has been for decades.
And I don’t need a constitution to tell me that I can own a gun.
So yes, the 2nd amendment is either irrelevant or it’s misunderstood. The second amendment doesn’t give me my right to own a gun. The Constitution and all of it’s Amendments don’t give the people anything - it’s a rule book for how the government is to behave. The government breaks those rules all the time and should be corrected by the people in the form of an active, intelligent voting campaign where our electoral officials carry our votes to the federal government.
The Second amendment doesn’t give me a right to do anything. God did that when he created us not with teeth, claws or strength or speed - he created us with cognitive functions that are unlike anything else in the animal kingdom.
So yea, I sorta agree with this anti-gunner although for somewhat different reason and certainly with a different result.
“It is just more proof that the left wingnuts live in their own fantasy world where inconveniences like facts can’t get in their way.”
Agreed. These people also do not want to recognize that the law abiding in places like Vermont, Maine, New Hampshire, Texas, Montana, the Dakotas, and elsewhere like that live under fairly casual and permissive firearms laws and by the very fact that they are law abiding, do not commit crimes and certainly not violent ones. Whereas places like Chicago and DC have strict laws, criminals by their very nature do not obey those and many other laws in order to carry out their nefarious enterprises. And very much the same applies to mentally ill persons who are not dealt with in terms of receiving proper and institutionalized care.
There is a rarely made observation of immense importance in a discussion of the individual's Second Amendment right to protection from government interference.
The observation is to question the individuals right to gun ownership without the Second Amendment protection.
Does Congress have the enumerated power to legislate gun ownership if there were no Second Amendment?
What do you say?
Hard to believe this is the same newspaper that printed Orr’s pro-gun cartoons back in 1934. I used to post it here till Photobucket screwed up my account. I do post it often on FR Facebook.
Going to a gun show today to celebrate my 2A rights. Molon labe!
Too funny - attacking that which they claim to be “irrelevant” w/o realizing that it is indeed irrelevant to their screeds ...
Chapman, 2nd Amendment is the 2nd amendment for a reason - in fact, you are quite fortunate that the Founding Fathers did not make it the very 1st amendment. Ponder that for a bit, idiot.
So the fact that leftists long ago decided to infringe makes the amendment irrelevant, exactly as we predicted they would.
The 2nd Amendment actually protects most of the world. In the U.S. it prevents a totalitarian government from coming to power.
If a totalitarian government comes to power in, say disarmed Australia, they have the U.S. to save them. If a totalitarian government comes to power in the U.S., there’s no one to help, and before very long at all the entire world would be under the boot of totalitarian government.
