A three- judge panel declined to certify the recount of a key House race today, saying that a questionable ballot should be counted in favor of the Republican and tying a race that Democrats had thought they had won by a single vote.
“The court declares there is no winner in this election,” said Circuit Court Judge Bryant L. Sugg, after the judges deliberated for more than two hours.
The court’s decision leaves the race for the 94th District tied at 11,608 votes for each Del. David Yancey, the Republican incumbent, and Shelly Simonds, his Democratic challenger.
And it leaves the balance of power in the state legislature at 49-51, in favor of Republicans - at least for now.
In the case of a tie in a House race, state law says the winner is chosen by lot – essentially, a coin toss, according to Virginia state law.

They tried to give it to a Demoncrat but the judges said no one gets it because it was a questionable vote. Meaning they didn't really know who it was meant for.
The other changed vote he slashed the original vote and then filled in another bubble. He slashed this original vote and did not fill another bubble, but then he slashed his slash.
I can see awarding it to the republican. The guy should have requested another ballot.
Wait they count that as a Democrat vote? That’s clearly a vote for Republican Nevada Republican for all the other candidates the Democrat was crossed out in the Republican Yancey was filled in.
Yeah, it’s not like they charge you for another ballot.

That’s because they use a two headed coin and the dem always gets heads.
100,000$ to the guy who cast the ballot and he will declare he voted democrat and was molested by a republican.
I say let the Democrat win and let them control VA for a while and give Virginians a hard lesson of living under Liberal rule. Maybe they will be wiser afterwards and never give then power again (unlike us here in CA)

That never works. When the rats get power they do everything they can to make sure they never lose it. The rat Governor killed every measure to stop the voter fraud in VA.
