Doug Jones’ Victory May Give Trump A Second Supreme Court Pick
Daily Caller ^ | 12/13/2017 | Kevin Daley

In a political environment as volatile as this, his power as the Court’s swing vote is at its maximum. It seems counter intuitive that he would retire as his influence reaches its apex. What’s more, Kennedy has a high opinion of the Court’s capacity to bear moral clarity for a restless nation, making his continued service a matter of duty.
However true this may be, the justice is 81 and he is, after all, a Republican. Given his age and political inclinations, it is reasonable to assume he would like to retire and would prefer to do so under a Republican president. Jones’ stunning victory Tuesday betrayed the vulnerability of the GOP’s Senate majority, and the very real possibility that Democrats will seize control of the upper chamber in November 2018.

Not as unlikely as you might think. Dem turnout has been massive in all the special elections. They are energized and organized. The replacement of Corker and Flake give the Dems the opportunity to take these two seats. Unless the GOP can prove it can govern, there is a very real possibility the Dems can take over Congress in 2018.

12 of the 25 Dem seats are considered safe compared to 4 of the Reps. A lot will depend on whom the Reps select to run against Tester, McCaskill, Donnelly, Mancin, Heitkamp, and Baldwin, i.e., those I consider to be the most vulnerable. Heller is going to have a hard time being reelected.

I agree that the GOP will probably hold the senate majority in 2018. But why wait if you have a sure majority now? Notice how carefully they set up the ambush for Moore. They shut up the accusers until it was too late to change the name on the ballot, and then they all magically appeared. Compare that to the GOP buffoonery.

HAT TIP VENDOME The Moore race was a one off. Dems have been saying each race is "a referendum on Trump "and then they lose.

Yes. The Demwits do get over confident.

Well it very much looks like they are going to pass the tax reform bill before Jones makes it to the Senate in January.

I noticed and hard not to.

Maybe. But the tactic of false accusations does work....and there is no defense against it.

As a result, good honest people will not run for office because of what will be done to them. No one wants to lose their good name because they ran for office. And crooks don’t care.....so that is all you get as candidates.

Our country is doomed.

If Kennedy believes that the senate is in danger and wants to retire soon, I don’t see how that could be bad.

No, they know the power of advertising. To them, words are a means to an end: not a means of communication.

An index of just what a despicable, unspeakable viper Souter was: He resigned while a Democrat was in the White House.

The Republican establishment plucked Hastert from the high school locker room to become Speaker precisely because he was known to have a “problem,” and was totally controllable.

What is McConnell’s “problem”?

What is Ryan’s “problem”?

Taking the Moore election as a referendum for the 2018 elections is very misleading. The GOPe, the nonsense Media, the spurious accusations against Moore, and Moore was out spent that I’ve seen written up to 14 to 1. Couple all that with Moore was not very good on the campaign trail and it still ends up in a squeak win for the Establishment.

11 months is an eternity in politics. Heck a week is almost an eternity in politics these days. Trump will get the troops to show up. I believe he’s going to run the mid-terms like another presidential campaign or close to it. Like no other President in recent memory has done before. The bottom line, I like our odds a lot better than the Demwits for 2018.

I agree it's not if Trump gets in someone to the right of Kennedy. Post 6 covers it.

But it is unlikely that Kennedy will remain on the court for the full four years of the Trump presidency. While he long ago hired his law clerks for the coming term, he has not done so for the following term (beginning Oct. 2018), and has let applicants for those positions know he is considering retirement.

That articie is from July 2017, and Kennedy did hire one law clerk for 2018. However, retired Scotus justices are allowed to have one clerk.

I have an even better scenario — Ruth Bader Ginzburg’s long overdue departure from this world.

Sorry if that offends anyone, but from now on the only good Leftist is a dead Leftist.

“Say something like: “Did he rape you before or after not paying his taxes?””

Most of the Senate Republicans are country club Republicans. They have no sense of humor nor wont to fight the good fight. They got into office and their only mission in life is to hold on to the seat until they retire.

When you think about it, as long as Trump can pick Kennedy’s replacement, and maybe get one more pick, at least the country will be moderately safe from a rat takeover.

Kennedy is not very reliable. If he were to resign and be replaced with a solid conservative, it would be a major gain.

Let me predict right now that there will not be another originalist approved to the Supreme Court period.
