Of course it is. This started in the late 60s when juries in the south let klan members off easy. So then we had federal trials for civil rights violation. Apparently if you murder someone and are found not guilty, then you violated their rights and the feds can try you for basically the same thing. This bastardization of the court system by liberals has allowed this to stand up to the USSC.
The simple answer is it is double jeopardy. The only solution to this situation now is to sentence him to the max on the possession charge, deport him, or some vigilante put a round in the back of his skull.

The results however, would be a massive backlash against anything that enables illegal aliens to breath American air. DACA would die and wither so fast would implode the career of anyone in congress who gets near it. Sanctuary cities? Federal finding suspended. Employ illegals? Expect a visit from Uncle Sam and afterwards expect a permanent boycott of any business the owner is ever associated with again.

I believe that this Illegal Alien murderer was not tried for Felony murder, but for manslaughter. The Justice Dept could probably have him charged for Murder 1 or 2. Either way it doesn’t exonerate the fact that the morons in San Franpyshco did not find this illegal guilty!

.... Felon in possession of firearm = also a federal felony.
Double jeopardy argument there though...
IIRC, it’s a Federal crime for an illegal to possess a firearm. No double jeopardy.
Likely a warrant for re-entering the USA after being deported. Can be sentenced to jail time for that.
