Officer placed on leave as DA launches criminal investigation into arrest of Utah nurse

Salt Lake City Mayor Jackie Biskupski announced that as a result of the criminal investigation being launched by the Salt Lake County District Attorney, Detective Jeff Payne will be placed on full administrative leave with pay.

Later Friday night, police stated two employees are on administrative leave. It was not immediately clear who the second employee is.

She sure does. No warrant to obtain blood violates the HIPPA law of patient confidentiality, plus her rights under the fourth and fifth amendments. Including assault and battery.

She just hit the judicial lottery. It was all taped.

The big concern here is the lawlessness of the police, and that has far, far bigger implications for our nation, and possibly even for the truck drivers family.

I have to now wonder just what he has done to other people that we don’t know about...he should be fired from both jobs and I hope this nurse sues him for everything he hopes to have the rest of his life!!!

Didn’t work so well at Nuremberg. Must be a lawful order to be valid. The fine points of the law were already in agreement between medical and law enforcement services for procedures. The officer acted in violation of law and precedent.

Roid rage type behavior is not acceptable when a narrow exception to police authority exists, which results in frustration to an officers goals.

He certainly should. And from a liability viewpoint alone, either employer would be crazy to keep him on. If they keep him on, and he does this again (and he will), the lawsuit awards would be astronomical.

Because this time the employers can’t say they didn’t know he was a problem.

Administrator holding a conference call with hospital legal also involved? Admin. called Salt Lake Mayor before nurse ever made the precinct booking desk? Charges were never made and nurse was released from custody.

I think those cops could have dragged the perp out of the hospital bed and tossed him in the back of a cruiser if they wanted to. She had no more right to protect him than if he had run into a message parlor.

It seems the police were hoping to see if the trucker had alcohol or drugs in his system to absolve them of their creation/instigation of the wreak.

Well, let's see:
Deprivation of rights under color of law, false arrest, false imprisonment, kidnapping, common assault.

This is a partial list. I'm sure a lawyer or HONEST prosecutor could find a bunch more.

She was NOT Arrested. She was the Victim of a Violent Felony Kidnapping. Furthermore, it has been demonstarted in spades that there wasm a Conspiracy involved surrounding this Violent Felony Kidnapping.

They both deserve LIFE IN PRISON!!!

While I appreciate your concern for the trucker, his condition has absolutely nothing to do with this egregious abuse of police authority. And FWIW, it was reported today that as part of the trucker’s hospotalization, he had already had a blood draw in connection with his care. So all of this was moot at the time of the incident.
But next we will be seeing all the $hit about the “officer’s rights” and how they need to be “protected.” BTW, his boss has been put on leave as well now.

From what I read, this cop was acting on a request from the Logan, UT PD ( where the accident occurred). While there may be Federal Laws regarding trucker blood samples, it does not appear that federal law requirements were driving the blood draw.

“I suspect that the DOT regulation should be read as “IF the CDL holder wants to keep his license, he must submit to a blood test.” I don’t think the DOT can over-ride the law on warrants, right to privacy, etc. “

And at the time of this incident, the trucker was in a coma, not able to give or withhold consent.
