Louisiana judge rules Sofia Vergara’s frozen embryos are ‘citizens of California’

Modern Family star Sofia Vergara has been locked in a bitter custody dispute with Nick Loeb over frozen embryos she and her former fiancé had made when they were together for years, but she recently picked up a major legal victory in the public battle. Since the two split up, Loeb has aggressively tried to acquire custody of the frozen embryos. In his latest legal bid to obtain legal custody, Loeb filed an unusual right-to-live lawsuit against Vergara in Louisiana, the only state where frozen embryos have legal rights. He named the two embryos “Emma” and “Isabella” in court documents, and even went so far as to set up trust funds for them.

Loeb brought the lawsuit back in December and last week a judge threw out the case on the basis that it was filed outside the proper jurisdiction, given that the embryos were created in California. In court documents obtained by TMZ, the judge even kept up the theme Loeb started in the lawsuit, ruling that “Emma” and “Isabella” are “citizens of California.”

Blackmun himself said that if embryos were persons he would have to declare abortion as illegal.

Correct. Constitutionally, a citizen, an embreyo then requires due process before depriving it of life. That is really going to make things interesting.

An "embryo" ... truly an embryo ... new life? Not an "egg"? Wouldn't freezing an embryo risk killing the embryo? Isn't that "murder" or at least "manslaughter". If the frozen embryo dies, who goes to jail, parent or doctor?

They were fertilized. They are embryos, which are ova that have been fertilized by sperm.

Many frozen embryos are thawed, gestated, and born. However, there is a risk of death and a heightened risk of many health problems.

This story makes me sick and sad.

As a practicing Catholic I am not a fan of in vitro fertilization which requires the creation and freezing of a lot of embryos. You can end up with these kinds of bad situations.

Even worse (for me): when a woman is “impregnated” with the embryos, the doctor puts in up to a half dozen embryos—to make sure one of them implants. Later in the pregnancy if there is (for example) five embryos that implant, the doctor kills off 3 or four of the five, selective abortion.

.......or you get something like this happening, a gaggle of frozen embryos in dishes or tubes that are fought over in court, then often directly disposed of if someone doesn’t want all of them.

I've heard of such things with sperm and egg. But I guess I never had cause or opportunity to learn of embryos being "stored" so. This saddens me greatly. A life is created and then denied its opportunity to grow and explore. That's positively evil.

It’s been going on a long time. A quick search shows the first birth with a frozen embryo was in 1984. The first custody lawsuit was in 1989.
