Op-ed: Replacing Chaffetz requires following our Constitution

Utahns are consulting the U.S. Constitution more than usual because of Congressman Jason Chaffetz’s resignation.

A vacancy in the House of Representatives is unique among all federal offices because it must be filled by an election. No appointments are permitted for membership in what is often called “The People’s House.”

• Federal judges are chosen by the president, with Senate confirmation of the appointment. The same is true for Cabinet officers.
• Governors may make appointments to fill Senate vacancies. Former Illinois Gov. Rod Blagojevich infamously tried to auction the Senate seat vacated when Barack Obama was elected president; that’s why Blagojevich is in prison. Until the 17th Amendment in 1913, senators were appointed by state legislatures.
• Gerald Ford became vice president when Richard Nixon appointed him after Spiro Agnew resigned. Congress confirmed the appointment.
• When Nixon resigned, Ford became president. Ford was never elected as vice president or president — then he lost to Jimmy Carter when he sought a full term.

Only for serving in the House is an election mandatory. As set forth in Article 1, Section 2: “The House of Representatives shall be composed of Members chosen every second Year by the People of the several States. ... When vacancies happen in the Representation from any State, the Executive Authority thereof shall issue Writs of Election to fill such Vacancies.”

So Gov. Gary Herbert had a duty to call a special election to replace Chaffetz, as he did last week. But it stirred controversy because the Constitution’s guidance does not leave everything up to governors.

I was born and raised in Utah, and I’m Catholic, went to Catholic school...left and came back 4 years ago...

I have to stick up for the Gov. of this State...he is a good man and he sticks by the laws and he looks out for ALL of Utah...

Chaffetz, Lee are a different story...one that on a day that we are remembering those that fought for our Freedoms and gave their all, I won’t talk about...

But if you knew half of what is happening, you would understand...

If I wanted information like this, I would read the Washington Post and the New York Times.

Maybe you know what Jared, Vlad and Donald did on their summer vacation or when Bannon will be fired (or maybe he will only be removed from any work having to do with Utah?).

From reading the article, it seems that the Utah legislature never, in their entire history, got around to making up rules for special elections, something mandated in the US Constitution.

Really? Is that true, or did the governor just get too excited?

I loved watching them both in Benghazi hearings. Sounds like the Dems and the GOPe are working together.. like on the budget bill which increases refugees. With those two out of the way, The uniparty agenda should get easier.
