Markey Claims That Dems will Restore Filibuster for Supreme Court Nominees

Sen. Ed Markey (D., Mass.) claimed Monday that Democrats will restore the 60-vote threshold for Supreme Court nominees once his party retakes the majority in the Senate.

"When the Democrats return to the majority and capture the presidency, which we will," Markey said, "that day is going to arrive [and] we will restore the 60-vote margin."

"We will ensure that for the Supreme Court, there is that special margin that any candidate has to reach because that is essential to ensuring that our country has a confidence in those people who are nominated," Markey added. "Rather than just someone who passes a litmus test."

MSNBC host Katy Tur asked Markey earlier in the interview whether he and Democrats had regrets about opposing President Trump's Supreme Court nominee Neil Gorsuch, who was sworn in on Monday. Democrats mounted the votes to filibuster Gorsuch, a rarity for Supreme Court picks.

Markey castigated Senate Majority Leader Mitch McConnell (R., Ky.) and Senate Republicans for invoking the so-called "nuclear option" by lowering the cloture threshold from 60 votes to a simple majority of 51. He called their move "unprecedented" and said that they "destroyed" the Supreme Court nomination process.

The Senate then confirmed Gorsuch last Friday with a 54-45 vote in favor of his nomination, and he was officially sworn in on Monday.

This tactic was used by Senate Republicans to overcome the filibuster effort by Democrats, but it was initiated by former Senate Majority Leader Harry Reid (D., Nev) and Senate Democrats in 2013 when they controlled the chamber, the Washington Free Beacon reported:

Senate Democrats first employed the nuclear option back in 2013 to advance former President Obama's judicial nominations, although the Supreme Court was not included in the rule change. The move was used to circumvent Republican efforts to filibuster some of Obama's nominees

Three and a half years later, Democrats have threatened to filibuster the nomination of Gorsuch, President Trump's pick for the nation's highest court. The Senate's 52 Republicans threatened to use the nuclear option to break the filibuster and did so on Thursday.

Uh-huh. The Democrats set the precedent of throwing away the 60-vote threshold so they could pack the DC Circuit Court with their nominees, but they're going to bring it back for the Supreme Court, a far richer prize.

I would say this is true (except that they'd do so during the lame duck session after the next time they lose the Senate), but even that's not right. They probably WILL revive the filibuster in that scenario, but it will take 90 votes for cloture, not 60.

The “nonlinear” Senate 60 vote supermajority should be regarded as a violation of the equal state suffrage clause of Article V imo.
Article. V. The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate [emphasis added].

In 2018 there are about 30 Senate seats up and,IIRC,about 20 of them are currently held by Rats.And,IIRC,quite a few of those are seats in states that DJT carried easily.Seems to me that the chances of the Rats *picking up* three seats next year are slim,at best.

Actually, Dems have lowered the cloture threshold THREE times in the last century. Harry Reid was just the most recent in a long line.

Hmmm. Can we get him to pledge IN WRITING that he'll stand by this "principle" even if there's a future RAT President in power, sending SCOTUS nominations to a narrow 51-seat RAT majority Senate?

Markey is a liar. Schumer and Reid had previously said they would invoke the nuclear option if Clinton won and the Repubs filibustered her SC nominees.

Has there ever been a 60 vote threshold? Senators traditionally don’t use the filibuster on SCOTUS nominees and it only takes a simple majority to confirm.
