Tuesday on MSNBC’s “Andrea Mitchell Reports,” President Barack Obama’s national security adviser Susan Rice addressed reports she was responsible for the unmasking of names of Trump associates after the election during the transition period.
Rice said unmaking names in intelligence reports she received is standard procedure insisting, “I leaked nothing to nobody,” adding there is “no equivalence” between unmasking and leaking.

No, Ari said if it wasn’t political it was legal but some of this looks political.
Unmasking, without more, is not a crime. Illegal targeting can be, and maybe Rice is guilty of that, but I think she's on pretty solid ground if the search requests are for "communications of [Russian]".
She's going to hide in those "unmasking" weeds. I'd flush her out with the "discloses or uses information" crime, leaking the "dirt" is a felony.
A few weeks ago, she said she did not unmask.
Now she admits she did unmask, but did not leak.

True. Unmasking can be entirely legal. But I haven’t heard anything that makes me think it was in this instance. According to Nunes the info had nothing to do with Russia and Schiff saw it but did not contest Nunes’ description. It’s hard to see how there could be a valid reason to unmask in those circumstances.
And I suspect that this evidence is just the tip of the iceberg. They were obviously leaking this stuff to the media and possibly to the Clinton campaign even before the election. I think that if they had something on Trump we would know about it already. They did a lot of surveillance but got nothing and ultimately used the info for political purposes.

My point was that willy nilly unmasking, unmasking for political purposes, that activity is not a crime. It's also pointless unless carried out to a criminal act.
There can be illegal "electronic surveillance", but all this "electronic surveillance" material is already in the database, "nice and legal."
The unmasking doesn't have to be illegal to be a bombshell. I don't believe Rice's assertion that the unmasking had no political motivation, but getting a clear piicture of ALL of her unmasking is not going to happen. Leaking a smidgen of the material is a felony, and somebody (foru current aand former government officials, says NYT on Feb 14) leaked. And the press is all sorts of wrong in that transaction, misprison of a felony.
I’m not sure that is the case. It’s clearly violative of the law and it’s a crime to disclose info that was obtained under color of law but obtained thru means not authorized by the act. I would think unmasking is in that category.
She told Judy Woodruff that she knew nothing. Today she admits to unmasking but not leaking. Susan is not a very good liar.

She’s speaking in black lingo because she needs to use the black card.
When it comes to committing a crime, the question boils down to citing the statute, and correlating the facts with the elements of the crime. The crime that precedes leaking (and this crime can be by a different person), one must conduct electronic surveillance. So, under your view, unmasking is engaging in electronic surveillance.
I sure hope you don't get the impression that I am defending political unmasking. It's banana republic level stuff. IF we had a decent society, Rice would be shunned out of it for political unmasking, and here pretextual justification would be rejected out of hand. But we don;t have a decent socitey. Half of it, and nearly all of the press, finds nothing untoward in politically-motivated unmasking, when it cuts in their favor.
