The federal courts trample us again.
If Trump only needs a majority of the electoral votes that are actually certified by December, he wins outright.
Michigan's vote has already been certified. If they push the recounts past the deadline then the certified count will stand.
This whole thing is a mess.
1. Fed judge says start recount noon tomorrow.
2. Separately, Trump sued Michigan election officials Friday in a bid to stop a recount. Trumps attorneys asked the Michigan Court of Appeals to impose a temporary restraining order on the State Board of Canvassers and Thomas.
3. The state could end up wasting money and see its reputation tarnished if Goldsmith ordered the recount start immediately in light of legal challenges in front of the state Appeals Court that could halt a recount, Gordon said.
4. The Court of Appeals has given the Board of State Canvassers until noon Tuesday to respond to Schuettes suit. The elections panel has scheduled its next meeting for 9:30 a.m. Tuesday at the Capitol.

I think the judges ruling nixes all other state actions concerning the recount.
The 6th circuit court of appeals will hopefully stay this decision tomorrow before the counting begins.

It has nothing to do with an “option.” The scenario you posted seems to be exactly what the 12th Amendment says would be done in a scenario where any states don’t certify their electoral votes by December 19th.
State laws apply, the vote is certified. Time to break the back of the feral federal gubmint.

If the re-count is delayed past the date for certification (Dec 13), the state legislature is empowered to appoint its own slate of electors -- who would be authorized to attend an vote in the Electoral College (Dec 19).
Republicans control both houses of the Wisconsin, Michigan and Pennsylvania state legislatures. They would more than likely appoint the current slate of Trump electors.
No state is going to lose their EC vote. Nor will Trump lose any EVs.
Lets hope the MI AG and Trumps lawyers are on the ball first thing this morning and do a little Judge shopping of their own tomorrow and get one of the conservative justices on the 6th circuit to stay this Obama judges order, preferably prior to NOON tomorrow before the recount is to start!
wasn’t the recount already scheduled to happen because of a vote by state election commission? This federal ruling moves the start of the recount up by two days. Why is that a catastrophe?

If Michigan doesn't appoint its electors for any reason, then the number of appointed electors used to compute the majority will be reduced.
P.S. -- This hasn't happened in any presidential election in more than 200 years. I believe it only happened once -- in 1789, when New York didn't get their electoral votes certified in time.
So very vote is a tie, and the elections board is irrelevant to any of these disputes.
