When the two posed for pictures beforehand, however, Kobach was clutching his proposal and photographs captured the parts that his left hand didn't obscure.
They included uncompromising approaches to deportations, providing for the 'rapid build' of the wall that Candidate Trump promised for America's southern border 1,989 miles of it and part of a plan that appears targeted at making sure illegal immigrants can't vote in national elections.

If you crossed the border without proper authorization you committed a crime. You are a criminal. It does not take a trial to prove that (and I do not believe illegal aliens get a trial, there may be a hearing but not a trial).
It really appears that Trump vs "The Press" is like an adult vs children. They keep thinking he's stupid but they lose every time they go against him.
Let’s examine a few things, shall we?
Was this document classified? Doesn’t look to be marked as such.
Are specific plans something the PE wants to address openly in say a press conference? Probably not.
Are some specific plans something the PE wants to subtly communicate to his supporters? Probably.
Are some specific plans something the PE wants to subtly communicate to ICE agents who are basically being forced to look the other way? Does he want to boost their morale? Probably.
Does the PE want to encourage illegal aliens to self-deport and save the government the grief of deporting them? Almost certainly.
Please, maybe it was done on purpose.
I'm reminded of W leaving the White House carrying the book "Bias" where all could see the title
“A jury of your peers”. That only applies to bona fide citizens. Unless we want to start swearing-in illegals to act as jurors for other illegals. It’s fundamental. Those here illegally only have one right; the right to get the bleep out of our Country.

Look closely at the paper, intentionally left on the outside of a valise in plain view of a dozen telephoto cameras.

In industrial information gathering, the person with the sensitive information must take “reasonable steps” to protect the information.
So if the information is not “reasonably protected” it is not espionage if I collect it using non-clandestine means. If someone is holding a paper and I see it and photograph it, it’s not espionage because that information was not “reasonably protected.” An envelope will do.
Let’s say I’m signing in somewhere and the receptionist hands me the sign-in book then turns away. I take my camera and photograph the last five pages, to see who has signed in, when, and what company they represent. Not espionage. Now let’s say the receptionist has placed a rubber band around the left side of the booklet, so that I can’t see the filled-in pages without removing the band. If I remove the band and photo the pages, that’ espionage, because he took reasonable precautions against me seeing the pages.
So this target was openly holding readable text in an open place where people with cameras were allowed (including agents of a foreign newspaper), and one of those cameras photographed the open text. Not espionage even if Putin himself snapped the pix.
Although I agree with your general sentiment, I disagree that anyone arrested is a criminal, and that you have to have broken the law to be arrested. False accusations and false arrest do most certainly occur. One need look no further than Richard Jewell to demonstrate that false accusations occur. The guy had his life turned into a mess, was tried and convicted by the media, and was an innocent guy who actually saved lives by finding a backpack bomb. He died at 44, and I would bet the stress of what he went through contributed.
No “perhaps” at all. This was deliberate.
Illegal aliens are already breaking the law simply by being here, being arrested for anything else simply adds to it.

Remember, the press has been putting out the narrative that “Trump was backing off his promises”.
Now the idiots, in an effort to do a “gotcha” (although I still wouldn’t get how this would be), are reporting that he in fact is NOT backing off his promises.
