The Fatal Flaws in Comey’s Theory of Why Clinton Shouldn’t Be Prosecuted

The FBI director is a talented lawyer, but even he could not mount a convincing case for his actions.

In a quarter century in law enforcement, I never encountered anyone more confident, or with more reason to be confident, than Jim Comey. The former Bush Justice Department deputy attorney general turned Obama Justice Department director of the Federal Bureau of Investigation has earned bipartisan plaudits for a reason: He is as able as it gets. The nation got to see that this week: first, in his tour de force press conference both damning and clearing Hillary Clinton; then, just 48 hours later, in his deft jousting with a Republican-led House committee.

So well did Director Comey perform that you barely noticed his rationale withering away.

In arguing that Mrs. Clinton should not face felony charges of grossly negligent mishandling of classified information, the director illustrated that Mrs. Clinton is overwhelmingly guilty of grossly negligent mishandling of classified information. It made me wonder how many dozens — scores? hundreds? — of defendants Comey, in his 15 stellar years as a federal prosecutor, had convicted on a bare fraction of the proof he outlined against the former secretary of state.

----------------------------------------

The bureau’s job is to develop evidence that proves the essential elements of criminal offenses proscribed by Congress — and yes, the agents appear to have done the job very well here. Yet, the FBI is not there to analyze the validity of the statutes. And even more attenuated from the investigator’s role is the FBI’s assessment of legal claims a defendant might make about the propriety of a prosecution.

That is the Justice Department’s job. Director Comey should have let them do it. They have become expert at defending the indefensible.

Why didn’t any of those Congressmen ask Comey if friendly and clandestine intelligence operatives were outed by Clinton’s arrogant and indifferent handling of documents?

Comey’s theory of why Hillary shouldn’t be prosecuted is that he likes breathing.

She got the OJ jury.

At least OJ got a trial. What Comey did would have been the equivalent of Mark Fuhrman shrugging his shoulders and speculating the case shouldn't be brought. At least Fuhrman TRIED.

Comey CONFIRMED Hillary's lawyers did NOT have security clearances. But did that stop Hillary from granting them UNFETTERED ACCESS to her private server containing OVER one hundred TOP SECRET/SPECIAL ACCESS emails? NO.

Did that cause Comey to recommend that Hillary be charged with at least one felony for violating the espionage act? NO!!!!!!

Total circus, with 'Comey the Clown' as head ringmaster.

Thank goodness somebody is still talking about this. It is sad a racist black assassin killed some LEO, destroying 5 families, but James Commie destroyed the rule of law for all of us.

Still the much bigger topic, but somehow an evil mass shooter came out of the woodwork, right on cue to get the bigger issue of Hitlery and her corruption off the news cycle.

It is always this way with the Clintons. It is always some convenient crisis that comes to their rescue.

QUITE the COINCIDENCE I tell you.

What Comey actually did was get himself eyeballs deep in election politics. Something he has absolutely no business being involved in.

That's what happens when you go to work for Obama. You have to choose sides.

Comey and his Uniparty elite pals think this is not the case.

However, I can see the successors of Ammon Bundy and Cliven Bundy having a different view of the matter.

The gruberment created a number of "serious felonies" out of whole cloth in order to prosecute the Bundys and their supporters for "mouthing off" to the government.

Yet, when confronted with ACTUAL multiple serious felonies by Cersei Clinton and her crew, the government said "Never mind!".

Pure and simple: For whatever reason, James Comey gave aid and comfort to the enemy. He should forever be known as James Traitorcomey.

“Did you really think we want those laws observed?” said Dr. Ferris. “We want them to be broken. You’d better get it straight that it’s not a bunch of boy scouts you’re up against... We’re after power and we mean it... There’s no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren’t enough criminals one makes them.

“One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What’s there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced or objectively interpreted – and you create a nation of law-breakers – and then you cash in on guilt. Now that’s the system, Mr. Reardon, that’s the game, and once you understand it, you’ll be much easier to deal with.”

Atlas Shrugged, Ayn Rand.

This whole thing was just a stunt for the media.

Hillary Clinton wasn't prosecuted because she was using her private server to launder money from corporate/foreign contributors -- who were buying influence to get the same things out of her that they've gotten out of Republicans in Washington for years.

In Director Comey’s defense, Herself did not go unscathed. All the misdeeds of which Herself was revealed as having done were explained away, not through malicious intent on the part of Herself, but it boiled down to Herself being too unsophisticated to know or understand the laws pertaining to the custody and protection of the security of State Department business, or how the system even worked, that was for lackeys to fix and keep running. Also, like a schoolgirl protecting her diary, what Herself put into that system was for Herself and Herself alone to determine that which may be made public.

Adolescent, if not downright ignorant/stupid. And a vindictive adolescent, at that.

I’m still trying to figure out why the FBI Director was making a prosecution decision the Attorney General should have been making and announcing.

Oh yeah, she was caught just a few days before meeting with one of the targets of the investigation, so her credibility was already shot.

Now his is too. Like SO many others - touched the Clintons for a second, tarnished for life.

That's exactly what they revealed.

They've got enough laws to get ANYBODY - but Hillary gets a pass.

They pulled the same stuff with Lois Lerner.

Rule of law is dead in this country along with due process (4th & 15th amendments).
