Glenn Greenwald: The FBI was right not to arrest Omar Mateen before the shooting
Washington Post ^ | June 17, 2016 | Glenn Greenwald

Citizens should not forfeit their rights if they haven't committed a crime.

The massacre at an Orlando LGBT club has predictably provoked the same reaction as past terror attacks: recriminations that authorities should have done more to stop it in advance, accompanied by demands for new police powers to prevent future ones. Blame-assigners immediately pointed to the FBI's investigation of the Orlando shooter, Omar Mateen. "The FBI closed this file because the Obama administration treats radical Islamic threats as common crimes," GOP Sen. Lindsey O. Graham argued on Fox News. "If we kept the file open and we saw what he was up to, I think we could have stopped it." Others cited core fundamental rights, demanding they be eroded. "Due process is what's killing us right now," proclaimed Democratic Sen. Joe Manchin about the FBI's inability to act more aggressively against Mateen.

Ever since the Sept. 11 attack almost 15 years ago, every act of perceived terror, and even thwarted ones, have triggered identical responses.

Oh, we all agree. But the media doesn’t take this freedom loving tack unless it’s a Muslim mass terrorist.

His domestic violence and mental illness issues never made it to the NICS process to preclude his purchases or revoke his existing licenses. Government regulation is pointless if it is not implemented.

Thank you, though in his case the issues never rose to a criminal or commitment level. But if they had, particularly commitment, they might not have made it to the system anyway.

Read the fine print on your US passport. It cites the laws under which you forfeit your US citizenship. Among them is training or serving with a foreign fighting force.

That's a may, and over the years the Supreme Court has narrowed it largely to fighting for an enemy force, or if their was intent to forfeit citizenship. Americans for years have fought in foreign armies. I hadn't read he actually trained with the Taliban, if so I'd think that would have been enough to arrest him.

He was crazy...He was a wife-beater...Either/both of those two should be sufficient to bar his purchases.

With neither a criminal conviction nor a medical opinion that he's dangerous? Just some bureaucrat's or LEO's. I'd suggest your trust in government employees is misplaced.

He didn’t need security clearance to work on a DHS contract, he was never assigned to such work. Geez how many times do I have to.....

Believe it— ME-GIN actually has done a bang up job of covering the issue the last two nights. Have been shocked but she has been really pissed by it all and has had some very explosive guests on “telling all”.

Others will pick it up when it is their turn.

Agreed. Why if the FBI had just quietly followed him and checked out his acquaintances, it could have lead them right to the enemy headquarters and the big boss.

No one said he had to have been arrested. but they didn’t even monitor him. They didn’t even notify local law enforcement after the Disney warning in April.

Are you suggesting that you would not vote for him in six years if he were running (and alive)?

After all, his father apparently wants to be president of Afghanistan. Just think how much smoother things would go between our two nations with father and son each in charge.

Alas.

None of them will.

The FBI was right not to arrest Omar Mateen before the shooting...

...because the FBI is no longer allowed to gather evidence against any Muslim.
