Former attorney general: Trump right to question judge’s fairness

Former Attorney General Alberto Gonzales says Donald Trump is right to challenge the fairness a judge overseeing lawsuits against him.

“An independent judiciary is extremely important. But that value is not the only one in play here,” Gonzales wrote in a Saturday op-ed for The Washington Post.

"Equally important, if not more important from my perspective as a former judge and U.S. attorney general, is a litigant’s right to a fair trial,” he continued.

“The protection of that right is a primary reason why our Constitution provides for an independent judiciary. If judges and the trials over which they preside are not perceived as impartial, the public will quickly lose interest in the rule of law upon which our nation is based.” Trump on Thursday said U.S. District Judge Gonzalo Curiel’s Hispanic ethnicity is “an absolute conflict” in three civil fraud lawsuits against the billionaire.

He said Curiel’s “Mexican heritage” makes him partial because of Trump’s calls for a wall along America’s southern border with Mexico.

Suppose the KKK was a huge problem and the judge was a member of the “KKK Lawyers Association”. Suppose further that a politician wanted all KKK members to be prosecuted. Now suppose a case to which that politician is a party comes before the judge. The judge’s conflict is clear.

So, is Judge Curiel associated with La Raza? Does La Raza oppose Trump politically?

So, is Judge Curiel associated with La Raza? Does La Raza oppose Trump politically?

The answer to both questions is yes.

Judge Curiel is associated with a racist organization. That racist organization opposes Trump politically.

Judge Curiel’s conflict is clear. His impartiality may reasonably be questioned, he should recuse himself.

No. You obviously are ignorant of the following fact: this Judge is a member of the La Raza group. They are racists.

This Judge should never have been assigned to this case. He is biased.

If a Judge was a member of the KKK, you bet there would be charges of racism by a black litigant.

I've heard a great deal about this suit lately.

But I'd sure like to see one of the contracts...and a fair assessment of whether the contractual commitments were met, as I suspect they were.

But that fair assessment is not what the Democrats and their Race Thugs want.

I think there is more at play here. Trump really isn’t stupid. He is smart.

He is playing the same game among the general population that the elites have played for years—point at a particular aspect and history of someone who is (from his POV) hindering him.

By doing so, he is showing Joe and Jill Sixpack that when the left attacks him for any given aspect, Joe and Jill Sixpack will be able to say to each other, “Well, wait, isn’t that what Trump says about _______?” The attack from the left then tends to fall flat.

(a) Any justice, judge, or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.
(b) He shall also disqualify himself in the following circumstances:
(1) Where he has a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts concerning the proceeding;
(2) Where in private practice he served as lawyer in the matter in controversy, or a lawyer with whom he previously practiced law served during such association as a lawyer concerning the matter, or the judge or such lawyer has been a material witness concerning it;

Maybe that is why Trump is not emphasizing the LaRaza connection. He doesn’t want it to appear that the downfall comes from him!

It’s all about La Raza! It drives me nuts when Republicans don’t lead with this information. He’s a member of a racist organization that publicly opposes Trump. The conflict of interest is astounding.

However, if he thinks that being a bigot who belongs to a violent anti-American organization *should* disqualify a judge, he is right.

Of course this bigot is not going to recuse himself. Why should he, when he has such a clear chance to harm the US? As for being removed, well, that could happen. Actually, if he fails to recuse himself that could lead to his being removed from the bench.

“Clinton, Sanders and Trump are the worst presidential candidates of my lifetime.”

The judge was outed by Trump. First pretty clumsily and then most definitively vis-a-vis La Raza. I don’t know what level of Judge he is but accusations like these that get dragged through the media are career busters.

The judge is so corrupt it is obvious to all. Just recently he decided to make all the Trump U documents available to the public. Within 24 hours he reversed himself and said he made a mistake and resealed the documents but not before the media had access to all of them to inflict maximum damage to Trump.

Trump accusing him of being corrupt is 100% accurate. The judge is now totally tarnished and Trump will win easily.

It’s difficult to see Trump’s litigation strategy here. If Trump really thinks that being a Mexican, donation to Clinton and being an immigration advocate disqualifies a judge, he is wrong. If he thinks the judge is going to remove himself, or be removed, he doesn’t know the law. If he thinks that this will somehow make the judge rule his way, he’s a fool.

Judges hate this kind of exposure.
