Well, you can simply look to the CNN article about Hillary’s e-mail sever scandal to get a hint. The relatively long article details the results of the Inspector General’s report and tries to remain objective by showing both sides:

Let that sink in for a minute … Clinton violated the law, but committed no crime.

My take on this is that they wrote this purely for the quote value knowing the majority of Hillary! people will run with the second phrase of this statement and hoping that that is what sticks in the minds of the uninformed.

I think it’s because the Federal Record Act specifies no level of offense, or punishment.

They are ignoring the elephant in the room: the compromise of classified information. That does specify an offense and punishment.
