New York Bars Must Serve Pregnant Women

Policymakers in New York have released new guidance which compels bartenders to serve pregnant women alcohol if they ask for it.

Published on Friday 6 May by mayor Bill de Blasio and human rights commissioner Carmelyn Malalis, the document aims to precisely state what actions constitute discrimination on the grounds of pregnancy.

The purpose of the document is to ensure that pregnant women are not discriminated against by employers and are provided a safe environment to work in.

The guidelines read: “Judgments and stereotypes about how pregnant individuals should behave, their physical capabilities and what is or is not healthy for a foetus are pervasive in our society and cannot be used as pretext for unlawful discriminatory decisions.”

Given examples of violations in the document include “a bouncer denies a pregnant individual entrance to a bar based on the belief that pregnant individuals should not be going to bars and/or drinking alcohol” and “a restaurant policy that prohibits staff from serving pregnant individuals raw fish or alcohol”.

While New York City requires restaurants to post warnings that drinking alcohol during pregnancy can cause birth defects, commission officials now state that health decisions are the responsibility of the pregnant woman, not a bartender.

Last year, the British Medical Association issued its own guidelines saying pregnant women should not drink alcohol at all.

I can’t see making this illegal. OTOH, I’d say you could get in SEVERE legal trouble for selling cigarettes or alcohol to a child.

But...

1. Why can’t a bartender (personally) refuse, or a bar refuse to serve alcohol?

2. And then if they do, the bartender and bar management/ownership is absolved of any responsibility for the child. I’ve learned (not the hard way, fortunately) that the ONLY time it is safe to ask a woman if she is expecting is if you personally see the baby crowning.

Can the women sue that bar tender later if her baby is born with fetal alcohol syndrome?

I agree with the decision on this one. Our government has made it an overbearing intent to tell us what to do, when to sleep, what to eat, where to work, how to get well, just about everything in our lives.

If she wants to take a drink and gamble on her unborn child’s health, that’s her business. The child is her responsibility.

I noticed in your entry you asked if she can sue the bar for serving her. Probably about as much as she can be arrested and tried for second degree murder or child endangerment. Same apples.

I think you are looking at it backwards.

The government is being hands off here, they are putting the boot on anyone who is not being, "politically correct." They aren't saying that pregnant women are free to drink, they are FORCING bartenders to serve alcohol to pregnant women, because other wise they'd be "discriminatory" or racist.

So you think the City has the right to punish any bartender who decides it's against his conscience? What punishment do you think that bartender should get?


I take it you think that businesses should be forced to serve at gay marriage etc. Maybe the New York City ca force Christians to pray to Allah? Just so they will be less Islamophobic?

An unborn child is a person. 21 year old mother goes into a bar and orders a drink... Why can’t the bartender refuse to serve her since her child will absorb the alcohol as well and the child is not 21...

I found that one out the hard way.

Our married daughter, who lives in a different state, was visiting us. I hadn’t seen her in more than a year. I noticed her belly was sticking out quite a bit. I innocently asked her if she was pregnant again

She said, “NO DAD, I’M JUST FAT”!!!

All caps because she said it in all caps........... 3 exclamation points too.

So bakers and photographers must serve for homosexual weddings, and the government can tell you not to eat at Chik Fil A, but the government can’t impose a sensible rule like this to protect health of child and mother?

I'm not saying the bartenders are or are being correct or not. What I'm saying is it is not the responsibility to determine the legitimacy of a business transaction when they are licensed to serve alcohol and the rules were established on who they could serve, i.e., people at the correct age and not reaching the point of intoxication (dram shop). The thought of an adult making a decision to do something within their legal choice and within the accepted and legal practices of their server then blaming anyone else for any collateral damage to "their" unborn child is just like blaming the gun manufacturers for someone killing someone with a gun. But serving the right clientel alcohol has no gender, asexual, color, religious, illegal or anything that can stop the transaction and never has. Gay marriages are an action based upon a blastphomy of all religions as they can not be accepted by God due to the religious writings in the Bible. So if a person refuses service to a gay marriage based upon their religious beliefs, they are practicing their religion and being forced by the government to go against their beliefs. So you're talking apples and oranges. What punishment should be given to the server? Nothing. He/she was within their legal rights. And if they are not within their conscience they should not be in that business as they have requirements to follow, those that are within the law. If I was running the establishment, and I have run them for the military, and one of my servers refused to serve someone for a personal reason, it better be a good one. The law is defined, just stay within it. red

No, I didn’t say that. I said if the government is going to punish the server for serving a woman by allowing a suit to be accomplished then the mother should be punished also for the things I mentioned. If they are going to handle the situation legally, and ignore the laws in place for servers, then what’s right for the goose is right for the gander.

You need to read the article. You don't understand what is going on here. This is only about the Mayor enforcing political correctness on people. He is saying that if a bartender won't serve a drink to a pregnant woman, he is a racist sexist evil person. That is what you are signing up for.

You need to study the United States, since you don't know about this country. The city government cannot "allow" a suit as you put it, and they certainly can't forbid it.

We have three branches of government, and a suit would be under the judicial branch. New York City doesn't have the power over a lawsuit, the judiciary does.

The founding Fathers gave us three branches of government. You basically want to take away one branch of government and put it under the control of another branch.

This article does not mention any lawsuits pregnant women initiated against bartenders. That is all in your imagination. Can you provide evidence of any such suit? (It’s possible there are a few - there are all kinds of crazy lawsuits. But did it go anywhere?)
