Trump campaign manager will not be prosecuted, sources say

A Florida prosecutor has decided not to prosecute Donald Trump’s campaign manager for battery after a March run-in with former Breitbart reporter Michelle Fields, sources with knowledge of the situation told POLITICO.

The decision not to press charges against Corey Lewandowski is scheduled to be announced on Thursday afternoon by Palm Beach County State Attorney David Aronberg.

Fields may still pursue a defamation case against Lewandowski, a source said.

Fields filed a police report last month after Lewandowski grabbed her by the arm and moved her out of Trump’s way following a press conference at Trump National Gold Club in Jupiter. She said he left bruises on her arm. Police later charged Lewandowski with simple battery, releasing video from surveillance cameras that shows Lewandowski reaching for and grabbing Fields.

Aronberg would not comment, but in a POLITICO interview last week, he pointed out that Jupiter police had a low “probable cause” standard to cite Lewandowski for battery. But the responsibility for moving forward with a full-blown prosecution rested with Aronberg’s office, which had to consider whether a crime occurred and whether they believed a jury of Floridians would prosecute.

“We have a higher standard to go forward with a prosecution,” he said.

I figure you know this, and I don't mean to be preaching to the choir, but just venting out loud. One has to be careful about "learning" from talking heads, all of them, even the ones you like, maybe especially the ones you like. They all make mistakes. Fact checking is a real eye-opener. Tedious, so reserve it for things that are important to your sense of curiosity.

That's normally true, but here there is a media feeding frenzy and a crazy bitch making an accusation on mighty thin content. Good luck for the PD, Florida law has such a broad definition of simple battery, that the case can be forward to the people who make the big bucks.

Smart move on the part of the PD, it is out of the line of fire, and the press and the accuser are not exhausted just yet. The cops can go about their usual business, one less thorn in their side. The prosecutor is going to be accused (again) of being partisan, the only thing we don't know yet is how much ink the press is going to spill against him. It's a given that the press is going to double down on the accusation against Lewandowski.

They're pouting because the DA did the right thing - they care not about Justice and the Constitution if they get in the way of their candidate....

Lewandowski is the new Richard Jewell and should make sure and sue Michelle Fields and everybody else who participated in the slander to send a message

Fields should also be charged for filing a false police report.

Heh. I did a google search on fields defamation, figuring to find recent reports about her plans against Lewandowski. I did find quite a bit of that, but also ran into the defamation case where she was defendant. I'd forgotten about that - knew it shortly after the recent dustup, as the reason she was not a regular on Foxnews anymore.

The world revolves around her, in her mind.

I guess by the letter of the law, Trump has a case against Fields. She grabbed him and he jerked his arm away from her. Fields violated the security envelop around Trump. According to some reports, the USSS had warned her before to not violate the space.

As a police officer i would have tried very hard to c9nvince both parties to grow up and get over it.....not every disagreement or bad behavior requires govt intervention.

I don't ascribe any blame to Corey. There was no way it could have been settled at the scene by a police officer since Trump was headed towards the exit with his security detail and campaign entourage. The contact was minimal at best if you look at the video. Fields didn't lose stride and she showed no emotion as she continued walking and looking down at her phone.

As I am sure you are well aware, Fields has a history of such allegations. She relishes in provoking such "incidents" and revels being in the limelight. This is all a tempest in a teapot that was amplified by Trump's opponents and the MSM. They called for the firing of Corey and bought off on the Field's allegations before the videos ever came out.

Fields is now threatening a civil suit for defamation that will go nowhere. She has a screw loose.

The test used to determine whether an arrest took place in a particular case is objective, and it turns on whether a reasonable person under these circumstances would believe he or she was restrained or free to go. A reasonable person is one who is not guilty of criminal conduct, overly apprehensive, or insensitive to the seriousness of the circumstances. Reasonableness is not determined in light of a defendant’s subjective knowledge or fears. The subjective intent of the police is also normally irrelevant to a court’s determination whether an arrest occurred, unless the officer makes that intent known. Thus, a defendant’s presence at a police station by consent does not become an arrest solely by virtue of an officer’s subjective view that the defendant is not free to leave, absent an act indicating an intention to take the defendant into custody.

An arrest constitutes a seizure under the Fourth Amendment to the U.S. Constitution, and thus the procedures by which a person is arrested must comply with the protections guaranteed by the Fourth Amendment or the arrest will be invalidated and any evidence seized during the arrest or confessions made after the arrest will typically be suppressed. The U.S. Supreme Court has ruled that arrests made without a valid arrest warrant based on Probable Cause are presumptively invalid under the Fourth Amendment.

Similarly, arrests made pursuant to a warrant that is later ruled defective may also be declared invalid, unless the officer in procuring the warrant and making the arrest acted in Good Faith.

I deal with facts then try to draw reasonable conclusions. Go online a##-hat and you will see the actual appearance notice. This is what it shows:

ARREST/NOTICE TO APPEAR

Then in the first section under Administration it states:

Date of Arrest: 03/29/2016

Then

Time of Arrest: 08:10

Then

Charge: BATTERY-SIMPLE (TOUCH OR STRIKE)

Then

Statute Violation Number: 784.03(1)(A)(1)

Now if you have the document in front of you notice where “Booking Date” is left blank.

Which means his fingerprints, mugshot were not taken. If the prosecutor had decided to proceed on this bogus “charge”  then he would have had to be “booked.”

So as noted when the press used “charge”  it was merely in a colloquial sense.

Secondly, the Jupiter Police themselves noted he was arrested. Thats a fact.

Again, so what? The prosecutor, despite all the drama is not proceeding with any ‘charge’ because the case is bs. Just like your posting.

LOL. This is the level of discourse you are capable of. I am glad that you took the time to get the facts that you didn't have before.

So unless the prosecutor decides to pursue the charges, someone is not booked? That doesn't make sense. People are booked all the time without waiting for the prosecutor's decision.

The Trump camp has contested the assertion that Corey was "arrested." Here is the FL Criminal Code on Notice to appear

If I recall, your post doesn't include it, there was a court date set sometime in May. The prosecutor appears to have short-circuited the process without Corey even having his day in court. Does this really constitute an arrest and something that will be on his record?

I have always said it was BS, including the "arrest." Trump's political opponents and the MSM made it into a much larger issue than it really was. Cruz and Kasich called for the firing of Corey. 16 female "journalists" signed a petition calling for his removal and that criminal charges were justified.

At 2 PM we will hear from the Clinton supporter prosecutor who will no doubt imply that the decision not to prosecute does not mean that Corey was innocent of the charges, just that they had insufficient evidence to convict him. And then the drumbeat will once again start for his removal.

In the meantime Fields is threatening a civil suit against Corey and Trump for defamation. It is all BS, but you need to do your homework before making assumptions. And name calling does nothing for your assertions.

Perhaps you could answer a question about the Incident Report.

Is there a copy somewhere that spells out what the actual incident (allegations?) were?

The only thing I’ve seen is blank where the complainant’s description would go.

IE: Where is this verbage: “He then tried to yank me to the ground. He walked away. I showed my colleague large bruises.”

That page has circulated as if it’s irrefutable proof that the incident happened exactly as described—but I can’t find where it IS described in the JPD’s report.
