Trump University plaintiff seeks to withdraw from lawsuit

SAN DIEGO (AP) — Tarla Makaeff has had enough of Donald Trump after spending six years fighting him in court.

The Southern California yoga instructor wants to withdraw from a federal class-action lawsuit that says Trump University fleeced students with an empty promise to teach them real estate. Her lawyers said the Republican presidential front-runner and his team have put her "through the wringer" and made the prospect of a trial unbearable. A judge will consider the request Friday, four days before Florida and Ohio hold their primaries.

Trump's attorneys say the lawsuit should be dismissed if Makaeff is allowed to withdraw, arguing that their trial strategy centers on her. They deposed her four times and identify her as "the critical witness" in a court filing.

Makaeff's attorneys say Trump's argument that their client is indispensable to the billionaire's defense "is illogical to the point of being nearly incomprehensible." They note the judge allowed two plaintiffs to withdraw last year; three others would remain.

The tussle in one of three lawsuits against Trump University comes as the case nears trial, possibly this summer. A trial date has not been set, but a final pretrial conference is scheduled for May 6 and Trump appears on a list of defense witnesses who may testify at trial.

The lawsuit has figured prominently in the presidential campaign, fueled by legal filings and Trump's statements. In depositions that took place in December and January and were released last week, Trump acknowledged that he never met instructors whom his marketing described as hand-picked, and that some unqualified candidates had "slipped through the cracks."

The Better Business Bureau said Tuesday that it rated Trump University a D- in 2010, which improved to A+ by January 2015 as the business appeared to wind down

Plaintiffs in class action lawsuits do absolutely nothing. They have no expenses. The lawyers do all the work. She might have to give 1 deposition and produce her paperwork related to the course. She is quitting the case because she’s a terrible plaintiff. She has the nerve to try and blame her quitting on Trump. Probably the lawyers want to find a better plaintiff. The idea that thousands of people are suing Trump is ridiculous. It is just the lawyers and they just need one or two friendly plaintiffs. In the end, the lawyers end up with all the money. Everyone who has ever gotten a class action lawsuit notice in the mail or an email should realize this. You end up getting $0.50 and the court authorizes 20 million dollars for the lawyers.

Trump’s lawyers probably have scores of people that made lots of money using what they learned at Trump “University.”

seems to me, if Trump can be sued, so can most of the American universities that offer degrees in BS that lead to college graduate unemployment and the subsequent inability to repay student loans.

Trump sued for defamation, seeking $1 million. Makaeff prevailed on appeal, and a judge last year ordered Trump to pay $798,779 in her legal fees...

Oh it was ok when no one knew who she was, now being bought out and proved a liar, she’s not to interested now, so she pulled back...

Trump knows what he is doing, you don’t settle, go to court, most of the time, people will back off, and this is exactly what she is doing...

Sounds like to me that Tarla Makaeff just wasn't able to learn. Looks like the course was not to blame but a poor idiot student is the problem. Same thing in our current higher education facilities, some students are just goof offs.

Of course not, this is Trumps routine, keep it in litigation until you break the back of the small guy. In this case, Trump has probably threatened to sue her, and the threat is enough for her to know, further legal procedures would finish her off.

Wouldn’t you love to know how much this a$$ clown pays in legal expenses every year?

The claim is that Trump U promised to teach real estate investing and the plaintiffs claim that didn’t happen. It seems to me that should be easy to determine. How many students were there versus how many claim they weren’t taught. This sounds to me like a few people didn’t or couldn’t learn.

Trump filed a suit against her saying she was malicious. The court found that she was NOT malicious in her suit and her lawyer did very well in the settlement.

Not sure what happened in the suit, but under the law, malicious prosecution based on a civil lawsuit requires that the civil suit have concluded in a final judgment in which the defendant was completely vindicated. (Also, that there was no probable cause for bringing the suit and that the plaintiff was motivated by "malice".) I have not read anywhere that the case against Trump University has ever proceeded to trial and final judgment (i.e., judgment entered after all appeals are exhausted). So I don't know why Trump's lawyers would have filed an action for malicious prosecution, and if they did, I can see why it was dismissed in the pleading stage or at summary judgment. If such a cross-complaint were filed without meeting the requirements, I could see a judge awarding costs and maybe even fees to the other side.

Is that what happened here? If so, it has no bearing on anything related to what remains of the original case.

I find it curious that misrepresenting your business is now defended in earnest here.. Even at the height of the attacks on GWB, there was not a pattern of complete devotion to him at this level. The unbridled defense of all things Trump show he was right about the zealotry of his followers with the 5th Ave shooting statement.

And to call the entire Trump U issue frivolous, you have to forget there was a criminal investigation as well. That was dropped when the cease and desist in that state was obeyed.

Does that, plus his behavior of lawsuits (169 on record), sound like who you want in charge of the FBI, IRS and DOJ?

But maybe its just me, but if Trumps lawyers "put me through the wringer" for six years I think I could manage a few more weeks. Again, something about this story isn't right.
