FBI agents under investigation for possible misconduct in LaVoy Finicum shooting

An FBI agent is suspected of lying about firing twice at Robert "LaVoy" Finicum and may have gotten help from four other FBI agents in covering up afterward, authorities revealed Tuesday.

The bullets didn't hit Finicum and didn't contribute to his death, but now all five unnamed agents, part of an elite national unit, are under criminal investigation by the U.S. Justice Department. Inspector General Michael Horowitz is leading the independent inquiry.

The remarkable disclosure came as a team of local investigators released findings that two state troopers shot Finicum three times in the back during the chaotic scene at a police roadblock Jan. 26. One bullet pierced his heart, an autopsy showed.

A prosecutor ruled the fatal shooting was legally justified, saying state law allows use of deadly force when officers believe a person is about to seriously injure or kill someone. Finicum kept moving his hands toward a pocket that contained a loaded handgun. Although he was shot from behind, Finicum had a trooper in front of him armed with a Taser who was thought to be in danger.

Finicum got out of the truck with his hands raised and was immediately shot at.

I'll bet he knew that he had to give them some blood to save the woman and the girl.

My hat's off to him.

Unfortunately, the Government under this radical Marxist regime, lies to us every day and thus NOTHING the government says can be believed. That’s a sad situation.

It doesn't matter if the head of the government is a radical marxist, like it is today. Absolutely no one was punished for Ruby Ridge or Waco either. No one is going to be punished for executing this man, or for what they did in Waco more recently. This is not a republican or democrat thing. It is a feral, out of control monster at the national level that has no compunctions whatsoever about killing you or anyone else that embarrasses them. You and I are nothing to them, and they can kill you for any reason whatsoever and walk away from it with a commendation for a job well done.

As long as they keep playing the 'left' and 'right' off against each other, they have nothing at all to worry about.

I hope the gutless bastards that shot him know that payback is a bitch.

The ANONYMOUS gutless bastards in "pretend soldier" suits who flipped him off after they shot him, and probably spit chew on him as he lay dead.

Not really playing left vs right more like left vs left vs center vs right. The myth that there are any right-winger in either party is just that a myth. The problem is to many fools don’t understand that leftism comes in many forms and to many people are fighting over which leftism is better vs say all of them are evil and we need to at least move to the center

Normally I’d go with law enforcement but this one stinks. Shot in the back. Was he unarmed? Chaotic scene huh?

No, he had a loaded gun in his belt. The big video looks like he was going for it. I don't see much of anything on the small video except there were 2-3 others in the vehicle-one looks young-teenager.

I think you've partially got it right, but you're not really looking at it clearly, as the almost universal case in this country and pretty much across the world IMO. The basic problem is one of perception. How you think of things colors your perceptions, and any solutions you might proffer for the problems you percieve.

The primary mistake when thinking about the overall political situation is that you need to stop thinking of it as a left-center-right paradigm. That harkens back to how political parties were seated in the 18th century parlament in France. You cannot describe a political philosophy in two axes, because it is not just a one-dimensional spectrum that begins in one place and stretches to another. You have to at least think in two dimensions. Libertarians use something like this in "the worlds smallest poltical quiz". There are problems with this, mainly that it really doesn't cover enough issues. I figure you need at least 50-100 questions to really nail down a political philosophy. I think there are other problems with their reasoning in this as well, but to break things down into personal freedom and economic freedom (property rights) is a good start and will allow you to more rationally show the different ideologies prevalent in the world today, than just the simple right/left nonsense.

I'd probably add a 3rd dimension to it as well that would chart attitudes on 'collective responsibility" or something similar, because it would tend to show more about how strongly you support collective coercion to effect policy goals.

Right now, the powers that be, the establishment, or whatever you want to call them have it pretty darn good. They've managed to divide people into essentially two opposing camps, so they can play each camp off each other very effectively. Since we're always attacking each other, we're not focusing on the real threat to our lives, property and freedom, which is a central government with an insatiable lust for power and absolutely no accountability whatsoever when it comes to its actions.

Frankly, we're being played like a fine fiddle, and while the playing continues, the feral government continues to increase it's power over every single aspect of our lives. Democrat controlled government mercilessly attacks our financial freedoms. Then, after they've had a go for a while, a republican controlled government will act to restrict our personal freedoms, all the while leaving all the infrastructure in place that the democrats placed there. Nothing ever rolls back. Freedom is never restored. It is merely continuation of attack on our liberty from one direction or another all grinding mercilessly towards the eventual destruction of our republican form of government.

Oh, they'll keep the forms in place. They'll keep the elections going, because they know that when elections stop, that's when we'll finally realize the song is over. They also know that it doesn't matter who wins because the feral state controls all sides that matter.

Every presidential election year, you see various rumors flying around the conspiracy buffs of one side or the other talking about some imminent declaration of martial law so the elections won't be held, so the "evil" party (value of evil depends upon which 'side' you consider yourself to be on) won't have to face the voter's righteous indignation. This never happens because the powers that be are not actually affected by the outcome of the election no matter how it goes. They just shift around who's chairing what committee, or who is being paid as a lobbyist instead of as an elected official, but nothing fundamental ever changes.

The final nail in the coffin of our ability to actually do anything or formulate effective countermeasures against what is happening is that poltical discourse has been debased to the point that if an idea can't be expressed in a tweet or on a bumper sticker, then it is simply ignored. There are no discussions in any of these 'debates' about what the role of government should be, why it exists, or how it can be limited in extent. It's all just window dressing and talking about issues that fundamentally don't really matter all that much in the grand scheme of things.

Sorry about the rant. I'm all typed out. Also pretty darn frustrated with our Kardashian society.

They fired at the first stop because the kill zone had been meticulously prepared. They were not going to allow Lavoy to surrender at the first stop. He was being herded to the kill point.

Oh, I have been watching. I know what is going on. Doesn’t mean I have to approve or agree with what they say. Some actions are not justifiable.

Which ones are?

They shot his wife in the HEAD as she held her baby. They were threatening NO ONE.

All it takes is reciprocity. (i.e. they do stuff like that and then the same thing happens to THEIR families after the fact) Then the next person in the future to consider doing the same thing (shooting a baby) would wonder if THEIR baby will get shot in vengeance later.

Misconduct? How about murder?

This American was murdered by the agents of the central socialist government who used his murder as a possible example to others who would thumb their noses at the BLM.

It’s bad enough that we have to fight and die for the careerist politicians’ attempts to direct our attention to events outside of the continental USA. Now, we have to murder an innocent American and call it justified.

This entire government is a burgeoning monster that is suffocating the American people.

This is from WND article, “”We have talked with an independent investigator who has stated that the ‘video proves a set up assassination.’”

Joseph Rice, the Josephine County, Oregon, coordinator for the volunteer Oathkeepers.com organization and a leader with the Pacific Patriot Network, told WND many questions remain unanswered.

“How are ‘We the People’ to trust them the next time we interact with them?” he told WND.

“You’ve got agents willfully covering up the facts. That seems to claw at the integrity on the federal side of the investigation,” he said, calling for an independent review.

He explained that during the standoff he had spoken with both sides about how to resolve the disagreement and prevent a Waco or Ruby Ridge, two federal law-enforcement disasters that resulted in multiple deaths.

Rice pointed out that at least one of the individuals in the vehicle at the time of the shooting never was interviewed by investigators, who on Tuesday released details of their investigation.

He said the explanations fall short. Authorities, Rice said, claimed Finicum was shot three times in the back, yet he fell backward into the snow.

And he confirmed the family’s autopsy concluded Finicum was shot nine times.

For perspective only, from the Portland, Oregon Police Directives Manual.

First please note this:

Members should be aware the Bureau’s force policy is more restrictive than the constitutional standard and state law.

http://www.portlandoregon.gov/police/article/526353

Then with that in mind:

0630.05 Vehicle Pursuits http://www.portlandoregon.gov/police/article/526054

Pursuits in General

The decision to pursue must be based on the belief that the benefit of capture exceeds the risk that the pursuit creates. This Risk / Benefit analysis must be constantly reassessed during the pursuit. The circumstances justifying the decision to pursue must exist at the time of initiation. The decision to continue in or terminate a pursuit may include additional information developed during the pursuit. Suspect’s driving behavior, which did not exist prior to the pursuit, should not be used to justify continuing the pursuit.

Prohibited Pursuits

a. Persons whose identities are known, who can be apprehended at a future time, and whose driving or conduct does not create an imminent threat of serious physical injury or death, will not be the subject of a pursuit. The sole exception to this prohibition is if the reason for the pursuit was his/ her involvement in a life-threatening felony.

Pursuit Intervention Strategies

d. Barricading: Barricading is considered deadly physical force and subject to DIR 1010.10. (ed. 1010.10 Post Deadly Force Procedures http://www.portlandoregon.gov/police/article/526379 )

1. Barricading requires the approval of a supervisor. Furthermore, the barricade must be set up in such a manner as to afford the fleeing suspect ample time to see the barricade and stop his/her vehicle.
