Although Florida media reported that Senator Marco Rubio’s parents were not US citizens when he was born, national media has largely avoided the topic. Senator Ted Cruz’s status as a natural born Canadian and a number of related eligibility lawsuits were underreported nationally, until news hit that an IL judge was hearing one of the cases.
Cruz’s lawsuits were filed in Florida, Vermont, Texas, Utah, Illinois, Arkansas, Alabama, New York, and Pennsylvania, and individuals who raised a ballot challenge in Indiana are weighing whether they’ll file suit.
Cruz has a new IL court date March 1st – Super Tuesday, a filing deadline on March 2nd for the AR case after his requested extension was granted, and a joint court date with one Senator Marco Rubio on March 4th in Rubio’s home state of Florida. Rubio’s pending lawsuits, court dates, and questionable defenses to the actions have been missing from the national discussion.
The initial narrative had Rubio’s parents fleeing Cuba’s Castro in 1959. It was later revealed they’d arrived in America in 1956 instead. Rubio’s parents did not become US citizens until nearly twenty years later, several years after Rubio’s 1971 birth. Their status as Cuban citizens, not US citizens, at the time of Marco’s birth prompted his inclusion in the Florida, Vermont, Arkansas and Indiana suits and challenges above.
Thomas Lee, a professor of constitutional and international law at Fordham Law School, explained a portion of the Originalist view of natural born citizenship, namely jus soli and jus sanguinis. As Mario Apuzzo elucidates:

I now think the plan was for them to have a significant portion of the delegates, and then be procedurally disqualified on concerns that they were unqualified (who would decide? The party leaders) at the convention if Yeb! wasn’t winning, so that the convention could be brokered to anoint the desired candidate.
In April 2008, Obama Soetoro agreed and signed SR 511 that NBC is born on US soil to two US citizen parents.
So did Hellary.
So did Coburn who today endorsed Rubio.

At a Judiciary Committee hearing on April 3, Leahy asked Homeland Security Secretary Michael Chertoff, himself a former Federal judge, if he had doubts that McCain was eligible to serve as President. My assumption and my understanding is that if you are born of American parents, you are naturally a natural-born American citizen, Chertoff replied. That is mine, too, said Leahy.
The U.S. Supreme Court has already determined that Cruz and Rubio are NOT natural born Citizens.
Neither the 14th Amendment nor Wong Kim Ark make one a Natural Born Citizen
What is ironic is both these guys, Rubio and Cruz, make a big deal about being faithful to the letter of the law in the Constitution. If this is not a deception, I do not know nothing.
So, if the courts find them eligible to be president, will any of you let this go? I think not.
I am not sure that you understand how this will go. It makes little difference which way the initial decision goes as long as all the pertinent evidence is presented. Most likely the only ones who will be ruled to have “standing” are the other candidates in the race. It is possible that Carson is hanging on to add his name to some of these suits.
If any of the cases are found to have standing and a decision is made it will be appealed immediately. At that point the decision will be reviewed by three federal judges. Then the majority decision that they make would be appealed to the Supreme Court.
The Supreme Court my or may not take the case. If they do... with the current makeup of the court they would likely dead lock and the appeals court ruling would stand. If they decided not to hear the case the appeals court ruling would also stand. Either way it is questionable whether a definitive ruling will actually be reached before the primary is over.
If Rubio or Cruz is nominated and then found to be ineligible; the GOP insiders will decide who to run against Hillary. How much do you want to bet that it would be their favorite guy Mitt? At that point we could just go ahead and give Hillary the oath of office, because there probably wouldn’t be much of a point in holding the General.
I would love to hear from some of the many lawyers that frequent Free Republic and have them give their esteemed analysis.
William Rawle, who was appointed by George Washington to be U.S. Attorney for Pennsylvania, wrote in his 1824 book on constitutional law that "every person born within the United States, its territories or districts, whether the parents are citizens or aliens, is a natural born citizen in the sense of the Constitution, and entitled to all the rights and privileges appertaining to that capacity." So that would cover at least Obama and Rubio, if not Cruz.

Much to its shame, The judicial branch covered up for O the last seven years, recalling also that O ran right to holding a secret meeting with the Supremes right at the start. Maybe Cruz/Rubio need to do likewise ( and give them the same “talking to?”)
So, just how the hell is it that NOBODY had standing to bring suit in terms of Zero’s eligibility, but it appears that EVERYBODY can sue to question Cruz and Rubio?

If Trump has the delegates and the required eight outright majority wins they will be stymied.

I will let it go if the Supreme Court finds them eligible. Sorry that Justice Scalia won’t be there to vote on it, tho’. Lesser courts not so much.

Wow, I think you are 100% correct, MrEdd. I always thot’ the Dems would be the ones objecting if either candidate got the nomination, but after listening to Yeb! always stating “Trump will never be President” I now agree this was the plan to shoo him in and Bush knew of it. Well, surprise, surprise.
